The operation of assistive mobility devices as those devices are defined
in § 1 of P.L. 2001, c. 430 (N.J.S.A. 39-4-14.10) and the operation
of electric-powered scooters, either with or without seats, is hereby prohibited
in the Township of Long Beach on any sidewalk, bicycle path, public parking
lot or any other public property or any public street.
A.
Any person apprehended operating an electric-powered
scooter, either with or without seats, or an electric personal assistive mobility
device shall, on the first offense, be fined not less than $100 nor more than
$250; for a second offense shall be fined not less than $250 nor more than
$500, and for a third offense be fined not less than $500 nor more than $1,000.
B.
The electric-powered scooter or the electric personal
assistive mobility device operated by any person violating the terms of this
chapter may be impounded by the Police Department for a period of not more
than 15 days for the first offense, not more than 30 days for the second offense,
and not more than 90 days for the third offense.
The prohibitions hereinabove imposed in §§ 149-1 and 149-2 shall not apply to any person who is the holder of a personal identification card issued by the Township of Long Beach Police Department showing that the holder thereof is entitled to the benefits afforded by the laws of the United States and the State of New Jersey to handicapped persons dealing with the operation of motor vehicles. The Police Department of the Township of Long Beach shall be and is hereby authorized to issue such identification cards under the following conditions:
A.
The applicant for such a card shall fill out an application
form to be developed by the Police Department of the Township of Long Beach
and submit the same to an officer designated in that Department by the Chief
to issue such permits. The applicant shall submit with the application two
passport-type photographs along with a check in the amount of $25 made payable
to the Township of Long Beach and a copy of either:
(1)
His or her motor vehicle registration showing that he
or she is entitled to handicapped privileges; or
(2)
A letter from his or her physician addressed to the Chief
of Police of Long Beach Township unequivocally stating that the applicant
is entitled, if the applicant is not the possessor of an automobile registration
showing handicap privileges to secure such registration or handicap motor
vehicle ownership.
B.
Within 10 days of the submission of such an application
in completed form, the Police Department of Long Beach Township shall issue
a photographic identification card authorizing the holder to operate personal
assisted mobility devices and electric-powered scooters either with or without
seats in the Township of Long Beach notwithstanding the provisions of this
chapter of the Ordinances of Long Beach Township.
C.
The exemptions created to the restrictions in this chapter above stated in §§ 149-1 and 149-2 shall not apply to the operation of such vehicles on Long Beach Boulevard in any section of Long Beach Township and the prohibitions contained in §§ 149-1 and 149-2 shall continue in full force and effect on that roadway.
