Whenever a term is used in this chapter which
is defined in P.L. 1975, c. 291, such term is intended to have the
meaning set forth in the definition of such term found in said statute,
unless a contrary intention is clearly expressed from the context
of this chapter.
All sections of the former Planning Board Ordinance
(Chapter 35), Subdivision of Land Ordinance, Zoning Ordinance or any
other ordinance of the Township of Mansfield which contain provisions
contrary to the provisions of this chapter shall be and are hereby
repealed.
A.
In order to comply with the requirements of Section 81 of P.L. 1975, c. 291, there is hereby adopted by reference thereto and the incorporation herein as a part hereof without fully setting forth the full text thereof the substantive provisions, as the same may be amended by the adoption of this chapter, of the Mansfield Township Subdivision of Land Ordinance and the Mansfield Township Zoning Ordinance, as the same are contained in Chapters 50 and 65 of the Code of the Township of Mansfield. It is intended that the Zoning Ordinance readopted and established by this chapter shall, in accordance with the provisions of N.J.S.A. 40:55D-90, be an interim Zoning Ordinance effective for a period of one year from the effective date of this chapter, as it will require additional time for the adoption of a new or substantially revised Master Plan and, accordingly, a reasonable interim Zoning Ordinance should be adopted until said Master Plan is adopted.
B.
Three copies of this chapter with the said Subdivision
of Land Ordinance and Zoning Ordinance of the Township of Mansfield
hereby readopted annexed hereto as Schedule A are and shall remain
on file in the office of the Township Clerk for public inspection.
Those ordinances contained in Schedule A annexed hereto shall constitute
a part of this chapter as fully as if set forth herein but shall not
be published with this chapter and notice of its introduction as is
authorized by P.L. 1976, c. 115.
This chapter shall be known and may be cited
as the "Land Use Ordinance of Mansfield Township."
Immediately upon adoption of this chapter, the
Municipal Clerk shall file a copy of this chapter with the County
Planning Board as required by law. The Clerk shall also file with
said municipality copies of all ordinances relating to land use, such
as the Subdivision, Zoning and Site Plan Review Ordinances.
This chapter shall take effect after final adoption
and publication of notice thereof, according to law.
