Township of Mansfield, NJ Traffic Control

Whenever any words and phrases are used in this chapter, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

§ 60-2 Trucks with GVWR or registered weight over 10 tons.

Trucks that have gross vehicle weight rating (GVWR) of over 10 tons or registered weight over 10 tons, whichever is greater, are hereby excluded from the streets or parts of the streets described in Schedule A, § 60-6, except for the pickup and delivery of materials on such streets. Said Schedule A being attached to and made a part hereof this chapter.

§ 60-2.1 Vehicles over four tons.

Vehicles over four tons' registered gross weight are hereby excluded from the streets or parts of streets described in § 60-6.1, except for the pickup and delivery of materials on such streets from residential dwellings and for vehicles utilized in farming operations.

§ 60-3 Stopping and standing prohibited at all times on certain streets.

No person shall stop a vehicle or permit it to stand at any time upon any of the streets or parts thereof described in Schedule B (§ 60-7), attached hereto and made a part of this chapter.[2]

§ 60-4 Violations and penalties.

Unless otherwise expressly provided for in another section of this chapter or in Title 39 of the New Jersey statutes, any person who violates any of the provisions of this chapter shall, upon conviction thereof, be subject to a fine not exceeding $2,000 or imprisonment in the county jail for a term not exceeding 15 days, or both; except for violations of N.J.S.A. 39:4-80 et seq., 39:4-105 et seq., 39:4-123 et seq., or 39:4-140 et seq., for which no specific penalty is provided, and in such instances the offender shall be liable to a penalty of not less than $50 nor more than $2,000 or to imprisonment in the county jail for a tem not exceeding 15 days, or both.

§ 60-5 When effective.

This chapter shall take effect immediately upon its final passage and publication according to law.

§ 60-6 Schedule A: Trucks With GVWR or Registered Weight Over 10 Tons Excluded.

§ 60-6.1 Schedule A.1.: Vehicles Over Four Tons Excluded.

In accordance with the provisions of § 60-2.1, vehicles over four tons gross weight are hereby excluded from the following described streets or parts of streets, except for the following exceptions: i) the pickup and delivery of materials on such streets or parts of streets from residential dwellings, ii) the pickup and drop-off of students on such streets or parts of streets by school buses, iii) for vehicles utilized in farming operations on such streets or parts of street, and iv) fire trucks and other emergency or police vehicles.

§ 60-7 Schedule B: No Stopping or Standing.

In accordance with the provisions of § 60-3, no person shall stop a vehicle or permit it to stand at any time upon any of the following streets or parts of streets:

§ 60-8 Tow-away zones.

Aaronson Road, which has been designated a no-parking zone in § 60-7 of this Code prohibiting parking on both sides of said roadway, shall also be included as a tow-away zone authorizing the township or its representatives duly designated and appointed to tow away any vehicle parked on said road from the southerly curbline of New Jersey State Highway Route 68 to a point 1,400 feet southwardly therefrom.

§ 60-8.1 Parking prohibited on certain streets.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule C (§ 60-8.2), attached hereto and made a part of this chapter. Every person convicted of a violation of this provision shall be liable to a penalty of $10.

§ 60-8.2 Schedule C: Parking Prohibited.

In accordance with the provision of § 60-8.1, no person shall park a vehicle at any time upon any of the following streets or parts thereof.

Editor's Note: This ordinance also provided that, unless another penalty is expressly provided for by statute, any person convicted of a violation of this ordinance or any supplement thereto shall be subject to a penalty of not less than $35 nor more than $350 or imprisonment for a period of not more than 15 days, or both.

§ 60-8.3 Parking prohibited during certain hours.

Wayne Drive. Except as otherwise provided herein, no person shall park a vehicle during the hours of 7:00 a.m. to 2:00 p.m. Monday through Friday upon Wayne Drive, on both sides, its entire length. This prohibition shall not apply during the following period: July 1 to August 31 of each calendar year; nor shall this prohibition apply to any resident of Wayne Drive. Any person convicted of a violation of this subsection shall be liable to a penalty of not more than $50 per violation. Excepted from this prohibition are moving vans and delivery trucks or vehicles, so long as the same are actively pursuing legitimate business purposes at the time said vehicles are parked.

Mansfield Road East. Except as otherwise provided herein, no person shall park a vehicle between the hours of 7:00 a.m. and 2:00 p.m., prevailing time, Monday through Friday upon Mansfield Road East, on both sides, its entire length. This prohibition shall not apply during the following period: July 1 through and including August 31 of each calendar year; nor shall this prohibition apply to any resident of Mansfield Road East. Any person convicted of a violation of this subsection shall be liable to a penalty of not more than $50 per violation, noting that excepted from this prohibition are moving vans and delivery trucks or vehicles, so long as the same are actively pursuing legitimate business purposes at the time said vehicles are parked.

All roadways throughout Township: tow-away zone. In addition to any ticket to be written under N.J.S.A. 39:4-138 for improper parking violations, in the opinion of the law enforcement officer, any vehicle parked or standing as to obstruct or impede a normal flow of traffic, or block entrances or exitways, driveways, loading zones, no-parking zones, oil fills, or any grassy area or pedestrian walkway, or present in any way a safety or traffic hazard, may be removed by towing the vehicle at the owner's or operator's expense.

All roadways throughout Township: enforcement. Any law enforcement officer shall enforce this section. Private citizens may identify a violation and report it to the police. Only a law enforcement officer or fire official acting in his official duty may take action to tow a vehicle. In the discretion of the law enforcement officer, of fire official, that officer or official may take reasonable efforts to notify the vehicle owner and request that the vehicle be moved to a proper location prior to initiating a tow request. The registered owner shall be responsible for the cost of the towing and storage of the vehicle.

§ 60-8.4 Parking at Mansfield Community Park.

Parking restricted. Parking of vehicles in the municipal parking lot at Mansfield Community Park and the Municipal Complex lots at East Main Street and Atlantic Avenues shall be restricted and regulated as set forth herein. No person shall park any vehicle in or on the parking lot between the hours of 10:00 p.m. and 6:00 a.m. except for municipal vehicles of the Township of Mansfield; vehicles of Township employees while at work for the Township; vehicles of persons attending meetings or events at municipal offices while such meetings are in progress; and persons displaying in their vehicles valid permits issued pursuant to Subsection B below. No person shall park any vehicle in or on the parking lot between the hours of 6:00 a.m. and 10:00 p.m. except for municipal vehicles of the Township of Mansfield; vehicles of Township employees while at work for the Township; vehicles of persons visiting or having business at municipal offices; vehicles of persons participating in or viewing municipally approved, sponsored or permitted recreational or other events at the park during the hours of park operation as determined pursuant to § 33B-4; patrons of Atlantic Avenue business during normal business hours; and persons displaying in their vehicles valid permits issued pursuant to Subsection B below.

Resident parking permits. Residents of the following property locations: 24570 East Main Street, 24582 East Main Street, 24590 East Main Street, 24594 East Main Street, 24622 East Main Street, 24640 East Main Street, 24654 East Main Street, 24664 East Main Street, 24674 East Main Street, 24674 East Main Street, 24680 East Main Street, 24688 East Main Street, 24696 East Main Street, 24702 East Main Street, 24706 East Main Street, 24714 East Main Street, 24720 East Main Street, 24726 East Main Street, 24734 East Main Street, 24740 East Main Street, 24744 East Main Street, 24750 East Main Street, 24756 East Main Street, 24764 East Main Street, 24776 East Main Street, 24786 East Main Street, 24800 East Main Street, 24812 East Main Street, 24822 East Main Street, 24840 East Main Street and 24854 East Main Street, may obtain from the office of the Township Clerk a permit allowing the parking of their owned or leased vehicles and those of bona fide visitors to their homes as set forth herein. Each household shall be entitled to up to two permits per licensed driver residing in the household, to a maximum of six permits, upon completion of an application and display of satisfactory evidence that they are licensed New Jersey drivers and reside at a qualified location. There shall be no charge for such permits, which shall be valid for a period of two years subject to renewal upon proof that the conditions of issuance still exist. Permits shall contain an expiration date and be numbered or otherwise identified so as to link permits with a particular household and identify permits that are no longer valid. The permits shall be displayed in the lower left windshield area of the vehicle so that they are clearly visible from the exterior. The permits shall allow the residents to park their noncommercial vehicles and those of their bona fide visitors in the parking lot serving Mansfield Community Park at all times. The Township Committee may, in its discretion, issue additional parking permits, whether or not to residents of the parcels identified above, when, in the opinion of the Committee, circumstances warrant. The Committee, further, may establish further regulations for parking by resolution, provided any such regulations shall be prominently displayed in or immediately adjacent to the affected parking area.

Signs. The Department of Public works shall erect appropriate signs notifying the general public of the parking restrictions and regulations set forth above, as well as the hours of park operation.

Enforcement. This section shall be enforced by the Township Police Department or by other persons who properly identify a violation and report same to the police.

Violations and penalties. Any person violating the provisions of this section, or any regulations promulgated hereunder, shall, upon conviction, be subject to a fine of $50 for a first offense, $75 for a second offense and up to $500 for a third or subsequent offense.

§ 60-8.5 Schedule D: Parking by Permit.

Parking shall be by permit only on the following streets or parts thereof:

§ 60-8.6 Schedule E: Parking of Certain Trucks, Vehicles and Trailers Prohibited.

No person shall park any commercial motor vehicle, motor-drawn vehicle, road tractor, semitrailer truck, truck tractor, school bus, or any other type of bus, omnibus or any recreational vehicle, camper, boat or trailer or pole trailer upon any of the street or parts of streets in any residential zone or in the C-1, C-2, or C-3 Zones in the Township.

§ 60-8.7 Schedule E exceptions.

The prohibition contained in § 60-8.6 above shall not apply to any such truck, vehicle or trailer during deliveries in the ordinary course of business nor while such vehicle is being loaded or unloaded. Further, this regulation shall not prohibit the parking of a commercial vehicle during the hours of 7:00 a.m. to 7:00 p.m. within 200 feet of property where the operator of such vehicle is actively engaged in the pursuit of his business, trade or profession.

§ 60-8.8 Parking prohibited during state of emergency.

Upon the declaration of an emergency, there shall be no parking upon streets where "TEMPORARY NO PARKING" signs are displayed. The Director of Public Safety or, in his/her absence, the highest ranking police officer of the Mansfield Township Police Department is authorized to declare an emergency and to direct the posting of "TEMPORARY NO PARKING" signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that "TEMPORARY NO PARKING" signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of any sign.

Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner of such vehicle shall pay the reasonable costs of removal and storage which may result from such removal, before regaining possession of the vehicle.

The effectiveness of this section is contingent upon the signs being erected or posted as required by law.

Enforcement. This section shall be enforced by the Mansfield Township Police Department or by other persons who properly identify a violation and report same to the police.

§ 60-9 Parking in handicapped parking spaces.

The Township Committee of the Township of Mansfield herein reaffirms and establishes all restrictive parking spaces now in existence and/or which may hereafter be designated by any public authority having jurisdiction thereover in front of residences, schools, hospitals and other public buildings and in shopping, business, commercial and industrial districts for use by persons who have been issued special vehicle identification cards by the Division of Motor Vehicles pursuant to the provisions of Section 2 of P.L. 1949, c. 280 (N.J.S.A. 39:4-205), when using a motor vehicle on which is displayed a certificate for which a special vehicle identification card has been issued, pursuant to Section 3 of said law (N.J.S.A. 39:4-206).

No operator of a vehicle shall stand or park the vehicle in any space appropriately marked for vehicles for the physically handicapped pursuant to P.L. 1977, c. 202 (N.J.S.A. 39:4-197.5), unless the vehicle displays a special handicapped vehicle identification card and/or is otherwise authorized by law to be parked therein.

Any owner or possessor of private property may request and receive enforcement of this provision as to spaces on his property which are designated and marked according to law.

Any person parking a motor vehicle in a restricted parking space without a special vehicle identification card shall be liable to a fine up to $250 for the first offense, and subsequent offenses fine at a minimum of $250 and up to 90 days of community service, or such terms and in such forms as the judge or municipal court deems appropriate, or any combination thereof.

All fines assessed for violations of this section shall be payable to and through the township's Violations Bureau.

§ 60-10 Reserved spaces in municipal lots.

No operator of an unauthorized vehicle shall stand or park the vehicle in or on a parking space in a municipally owned or controlled parking lot, which is designated and reserved for parking by emergency, police or municipal employees and/or fire trucks, ambulances and police vehicles, or otherwise block entrance and access to said designated and reserved parking spaces.

An "unauthorized vehicle," as defined herein, shall mean a vehicle which has not received permission from the Township Committee, Police Chief, Board of Fire Commissioners, Chief of the Fire Department or Emergency Squad to be parked in said reserved and designated municipal parking space.

No operator of a vehicle shall stand or park the vehicle in or on a parking space in a municipally owned or controlled parking lot which is designated by a sign limiting use of said space to fifteen minutes for a period longer than 15 minutes between the hours of 9:00 a.m. and 4:30 p.m., Monday through Friday, excluding legal holidays or any day the municipal building is closed for business.

§ 60-11 Speed limits on certain designated roads and streets; violations and penalties.

The speed limits for both directions of traffic along the roads and streets hereinafter designated are hereby established as follows:

Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this section or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days, or both.

§ 60-12 Truck traffic entering or leaving the Burlington County Solid Waste Facilities Complex.

Application. This section shall apply to all truck traffic entering or leaving the Burlington County Solid Waste Facilities Complex (hereinafter referred to as "County Complex"), including but not necessarily limited to trucks carrying solid waste (including dewatered and liquid sludges), recyclable materials, leachate, cover or products for markets.

Exceptions. The mandatory access and egress routes hereinafter established shall not apply to the following vehicles:

(1)

Pickup trucks driven by employees working at the County Complex for the purpose of traveling to and from their employment.

(2)

Vehicles hauling materials generated within the Townships of Mansfield, Florence and Springfield to the County Complex.

(3)

Vehicles from the County Complex to a destination within the Townships of Mansfield, Florence and Springfield.

(4)

Vehicles carrying waste eligible for disposal at the Complex's Convenience Center.

Mandatory access route. All truck traffic entering the County Complex must utilize Interstate I-295, leaving that thoroughfare via Exit 52 (Florence-Columbus interchange) to travel east on County Route 656 (Florence - Columbus Road), turning right on County Route 656 Spur, the new county connector road between County Route 656 and County Route 543 (Burlington - Columbus Road), thereafter turning right and traveling west on County Route 543 to the entrance of the County Complex. Except as otherwise provided for in this section, use of any other access route to the County Complex is prohibited.

Mandatory egress route. All traffic exiting the County Complex shall turn right from the gate of the Complex and travel east on County Route 543 (Burlington - Columbus Road), turning left onto County Route 656 Spur, the new county connector road between County Route 543 and County Route 656 (Florence - Columbus Road), turning then left and traveling west on County Route 656 to Interstate 295, whereupon said traffic shall travel on I-295 to other exits thereon. Except as otherwise provided for in this section, use of any other egress route from said County Complex is prohibited.

Emergencies. During emergencies or times when the prescribed ingress and/or egress routes are closed, all vehicles shall comply with the alternate routes set forth below:

(1)

In the event that any segment of I-295 other than the segment or any portion of the segment between Interchanges 47 and 55 is closed, all vehicles shall utilize the next available interchange to access I-295;

(2)

In the event of the closure of the northbound lanes of I-295 between Interchanges 47 and 52, vehicles traveling north shall utilize County Route 541 to U.S. Route 130 north, via the Burlington Bypass, to County Route 656 east (Florence - Columbus Road), turning right onto County Route 656 Spur and then turning right and traveling west on County Route 543 to the entrance of the County Complex;

(3)

In the event of the closure of the southbound lanes of I-295 between Interchanges 55 and 52, all vehicles shall utilize U.S. Route 130 south to County Route 656 east (Florence - Columbus Road), turning right onto County Route 656 Spur, then turning right and traveling west on County Route 543 to the entrance of the County Complex;

(4)

In the event that the segment of the access route between Interchange 52 and the entrance to the County Complex is closed, all vehicles shall exit I-295 via Exit 52, traveling then west on County Route 656 (Florence - Columbus Road) and turning left onto Old York Road and turning left again onto County Route 543 (Burlington - Columbus Road), proceeding then to the County Complex entrance; or

(5)

Upon any other emergency routes specially designated by the Office of Waste Management in consultation with the County Director of Public Safety and Emergency Management Coordinator at the time of such emergencies.

Violations and penalties.

(1)

Any person, firm or corporation who violates any of the provisions of this section shall, upon conviction thereof, be subject to the following penalties:

(a)

First offense: a fine of $250 or imprisonment in the county jail for a period not exceeding 30 days, or both.

(b)

Second offense: a fine of $500 or imprisonment in the county jail for a period not exceeding 60 days, or both.

(c)

Third and subsequent offenses: a fine of $1,000 or imprisonment in the county jail for a period not exceeding 90 days or to a period of community service not exceeding 90 days, or to such combination of punishments as the Municipal Judge may, in his or her discretion, deem appropriate and just.

(2)

Each violation of any of the provisions of this section and each day the same is violated shall be deemed to be a separate and distinct offense.[1]

§ 60-13 Statutory provisions applicable to Homestead at Mansfield.

The provisions of N.J.S.A. 39:1-1 et seq. and the provisions of Chapter 60, Traffic Control, shall be applicable to the semipublic or private roads, streets, driveways, terraces, parking areas or other roadways located within Homestead at Mansfield that are open to or used by the public, residents, tenants and employees for purposes of vehicular travel and shall be enforceable by those officers, agencies and individuals authorized to enforce the same under the laws of the State of New Jersey, pursuant to N.J.S.A. 39:5A-1. The maximum speed limit on any such roadway or thoroughfare intended for the passage of motor vehicle traffic shall be 25 miles per hour and shall be so posted. Stop intersections shall be as designated in the following schedule, and parking restrictions shall exist as contained in N.J.S.A. 39:1-1 et seq. and/or as set forth in this chapter.

Signs shall be placed at said spaces by the Trustees and shall conform in size and wording to the state statute. Penalties for violation of this subsection shall be as provided by state law.

§ 60-13.1 Statutory provisions applicable to Homestead Plaza Shopping Center.

The provisions of N.J.S.A. 39:1-1 et seq., and the provisions of Chapter 60, Traffic Control, shall be applicable to the semipublic or private portions, parking areas or other travelways located within the Homestead Plaza Shopping Center which are open to or used by the public, tenants and employees for purposes of vehicular travel and shall be enforceable by those officers, agencies and individuals authorized to enforce the same under the laws of the State of New Jersey, pursuant to N.J.S.A. 39:5A-1. The maximum speed limit on any such travelway or thoroughfare intended for the passage of motor vehicle traffic shall be 25 miles per hour and shall be so posted. Stop signs shall be erected at all exits onto public or semipublic roads or streets adjoining this shopping center and parking restrictions shall exist as contained in N.J.S.A. 39:1-1 et seq. and/or as set forth in this chapter.

There shall be no parking, standing or stopping by any vehicle in designated fire lanes within this shopping center except by authorized emergency or police vehicles engaged in official business. Any vehicle parked, standing or stopped in violation of this subsection may be removed by having such vehicle towed at the owner's or operator's expense; provided, however, that every reasonable effort is made to locate the owner or operator and to have him/her move said vehicle before such towing is implemented. In addition to having an illegally parked vehicle removed as herein provided, any person violating this subsection shall also be subject to the penalties provided by N.J.S.A. 39:4-139.2 et seq. and any other provision of general law or this chapter.

§ 60-13.2 Statutory provisions applicable to the Mapleton and Four Seasons communities.

General parking regulations.

(1)

All vehicles must park in designated areas and between the lines provided.

(2)

No person shall stop or stand a vehicle upon any of the streets or parts of streets described below, except in areas covered by other parking restrictions.

Regulatory and warning signs shall be enacted and maintained to effect the above-designated speed limits authorized by the Department of Transportation

No overnight parking. Overnight parking shall be prohibited in the Four Seasons Community on the following streets within the development from 1:00 a.m. to 5:00 a.m. except when a driveway is inaccessible due to driveway maintenance or short-term house construction or repair. Temporary overnight parking shall not exceed 72 hours from completion of the work. Driveway maintenance or short-term house construction or repair will be identified by tape or cones closing access to the driveway, and no vehicles shall be parked on the driveway. No on-street parking is permitted when snow is predicted or when roads are snow-covered.

Tow-away zones. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic or block entrances or exitways, loading zones, no-parking zones, oil fills, or any grassy area pedestrian walkway, or present in any way a safety or traffic hazard, may be removed by towing the vehicle at the owner's or operator's expense.

Authorized vehicles only. The following streets or parts of streets shall be designated as use for authorized vehicles only. No vehicle other than an authorized vehicle shall enter upon the below roadway.

Signs. All signs shall conform to the current edition of the Manual on Uniform Traffic Control Devices pursuant to N.J.S.A 39:4-198 and N.J.S.A. 39:4-183.27. The developer shall erect all such traffic control devices in accordance with this section.

Penalties. Unless another penalty is expressly provided for by statute, every person convicted of a violation of this section, or any supplement thereto, shall be subject to a penalty of not less than $35 nor more than $350 or imprisonment for a period of not more than 15 days, or both.

Dedication. In the event of the dedication of any of the roads, streets, or parking lots encompassed by this section to the Township of Mansfield and the acceptance of such roads, streets, or parking lots by the Township, such roads, streets, and parking lots shall become subject to the provisions of Title 39 of the Revised New Jersey Statutes in the same way and manner as any other public street, including the penalty provisions of laws and ordinances applicable to public rights-of-way, notwithstanding the provisions of Subsection J, above.

Severability. Should any portion of this section be declared invalid or unenforceable by a court of competent jurisdiction, the remaining portions shall remain valid and of full force and effect.

Effective date. This section shall become effective upon adoption, approval by the Commissioner of the Transportation, and publication in accordance with law.

§ 60-13.3 Statutory provisions applicable to County Route 545.

Truck traffic: Truck traffic is prohibited along County Route 545 (Georgetown Road) within the Township of Mansfield as requested by the Board of Chosen Freeholders of the County of Burlington in its December 11, 2007, correspondence to Linda Semus, Mansfield Township Clerk (attached hereto and made a part hereof.

Penalties. Unless another penalty is expressly provided for by statute, every person convicted of a violation of this section or any supplement thereto shall be subject to a penalty of not less than $35 nor more than $350 or imprisonment for a period of not more than 15 days, or both.

§ 60-14 Street and highway construction and maintenance operations.

[Added 10-25-1990 by Ord. No. 1990-28]

Preconstruction meetings. It shall be the responsibility of the person, firm or corporation wishing to conduct work on, above or below any roadway to contact the Chief of Police or his designee and the Township Engineer or his designee in order to arrange a preconstruction meeting and to submit plans at said meeting pertinent to working hours, flagmen and the safe movement of traffic during such periods of construction work. Any person, firm or corporation who fails to comply with this section prior to the start of work shall be deemed in violation of this section.

Emergency contact numbers. The person, firm or corporation conducting work covered by this section shall provide at the preconstruction meeting a minimum of two emergency telephone numbers at which contact may be made in case an emergency or other urgent reason for communicating arises before or during the course of construction. If, for any reason, emergency contacts cannot be reached or if the contact person fails to respond to a call from the police to correct a hazardous condition, the Township may respond to remove the hazard and in such event shall charge the reasonable cost thereof to the person, firm or corporation responsible for the project

Road closings and detours. Road closings and/or detours shall not be permitted unless approved in advance by the Chief of Police or his designee.

Flagmen. Flagmen shall be posted at all construction and maintenance sites when determined by the Chief of Police or designee that the same are necessary for the safe and expeditious movement of traffic. Flagmen shall be properly equipped and trained prior to directing traffic at the construction or maintenance site and the expense of posting flagmen shall be borne by the person, firm or corporation performing the work.

Stop-work order. The Chief of Police or his designee shall have authority to stop all work at the site and can order removal of equipment and vehicles, stored materials within the street right-of-way, backfilling of open excavation and any other related work to abate a nuisance or safety hazard or any violation of this section. Any expense resulting from a stop-work order shall be the sole obligation of the person, firm or corporation performing the work and in no way or form shall constitute a charge or lien against the township.

Violations and penalties. Any person, firm or corporation violating any of the provisions of this section, upon conviction, shall be subject to a fine not to exceed $1,000 or imprisonment in the county jail for a term not to exceed six months or shall be required to perform community service for not more than six months, or any combination of these penalties as the Municipal Judge may, in his or her discretion, deem appropriate and just. Each violation and each day said violation occurs shall be deemed a separate and distinct offense.

§ 60-16 Closing of streets.

The Chief of Police or Public Safety Director or, in his absence, disability or inability to act, the Mayor and, in his absence, disability or inability to act, then the Clerk of the Township of Mansfield is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.

Any regulations promulgated by the Mansfield Township Police and in accordance with Subsection A above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.

Any violation of this regulation promulgated there under shall be punished by a fine not to exceed $100.

§ 60-19 Prohibition of engine-braking.

Definitions. As used in this section, the following terms shall have the meanings indicated:

ENGINE-BRAKING

The use or operation of any mechanical exhaust device designed to aid in the braking, decompression or deceleration of any motor vehicle which results in the excessive, loud, unusual or explosive noise from such vehicle.

Prohibition. It shall be unlawful for the driver of any motor vehicle to use or operate or cause to be used or operated, at any time and on any road within the Township of Mansfield, any mechanical exhaust or decompression device which results in the practice known as "engine-braking."

Exceptions. The provisions of this section shall not apply to the application of unmuffled compression brakes where necessary for the protection of persons and/or property which cannot be avoided by application of an alternative braking system. Noise caused by the application of engine compression brakes, otherwise known as "engine-braking," which is effectively muffled or if the application is necessary for the health, safety and welfare of the community is exempt from the provisions of this section. Sounds created by emergency equipment for emergency purposes are also exempt.

Posting of signs. The Township is hereby authorized to post at reasonable locations within the Township signs indicating the prohibition of engine-braking.

Violations and penalties. Upon an initial conviction of any violation of this section, such person shall be punished by a fine of not more than $100 or by imprisonment for a period not to exceed 30 days, or by both such fine and imprisonment; and upon a second conviction, such person shall be punished by a fine of not more than $250 or by imprisonment for a period not to exceed three months, or by both such fine and imprisonment; and upon the third or any subsequent conviction, such person shall be punished by a fine of not more than $500 or by imprisonment for a period not to exceed six months, or by both such fine and imprisonment.

§ 60-20 Parking prohibited on public roads, streets, right-of-ways or other improved road surfaces when snow exceeds three inches.

No parking on any street when snow covered. Parking on any street, road, alley or other improved road surface used by motorized vehicles and maintained by the Township shall be prohibited when snowfall is in excess of three inches, or that sufficient ice or slippery conditions have developed so as to create driving and walking hazards. Vehicles found to be parked on said roadways shall be ticketed.

Violations and penalties. Unless otherwise in another section of this chapter or Title 39 of the New Jersey Statutes, any person who violates any provisions of this chapter shall, upon conviction therefor, be subject to a fine of $50 for the first offense; $100 for the second offense; and $250 for the third and any subsequent offense.

Approved off-street parking. Off-street parking shall be permitted during such weather events in the following parking areas: Mansfield Community Park, Country Walk recreation area parking lot, Georgetown Park in the Mapleton Development.

Approved lawn parking. Lawn parking will be permitted for 48 hours following the conclusion of the storm event creating a minimum of three inches of accumulated snowfall. All vehicles must be removed from any lawn area at the conclusion of the 48 hours' period or be subject to the same fines and penalties referred in this chapter.

Fire hydrant accessibility. Fire hydrants located on private property, or rights-of-way shall be kept clear of snow, ice and debris by the property owner. Hydrants located on public property shall be kept clear by the Township Fire Marshal, who shall be responsible for the enforcement of this provision.

§ 60-21 Fire lanes and zones; Title 39 enforcement.

There shall be no parking, standing or stopping by any vehicle in designated fire lanes or designated fire zones on any property in the Township, except by authorized fire, emergency or police vehicles engaged in official business.

This section maybe enforced in accordance with N.J.S.A. 39: 4-139.2, the state "Parking Offenses and Adjudication Act."

The owner of any private property in Mansfield Township on which a shopping center, retail, office, commercial, industrial or other nonresidential use is used or operated shall be deemed to have consented to the enforcement of the state motor vehicle laws established in Title 39 of the Revised Statutes of the State of New Jersey. Consent to Title 39 enforcement shall be deemed a condition of any approval by the Township Joint Land Use Board and shall be included as a condition in any resolution of approval for any private shopping center, retail, office, commercial or other nonresidential use.
