As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Includes persons, firms, copartnerships and corporations.

A. 
No person shall engage in or carry on any business in Margate City, or aid or assist as employee, clerk or otherwise in carrying on such business, or in using any wagon, vehicle, stand, store or other place or thing or sell or offer for sale any goods or thing for which a license is required by the terms of this chapter, unless a license as herein provided for shall have been first obtained therefor.
B. 
Applicants for a mercantile license shall provide proof of compliance with N.J.S.A. 40A:10A-1 et seq. which requires business owners and owners of a rental unit or units to maintain liability insurance for negligent acts and omissions as hereinafter provided.
(1) 
No person shall engage in or carry on any business in Margate City, or aid or assist an employee, clerk or otherwise in carrying on such business, or in using any wagon, vehicle, stand, store or other place or thing or sell or offer for sale any goods or thing for which a license is required by the terms of this chapter, unless a license as herein provided for shall have been first obtained therefor.
(2) 
The owner of a business shall maintain liability insurance for negligent acts and omissions in an amount of no less than $500,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.
(3) 
Applicant shall provide proof that the certificate of liability insurance has been registered on an internet website maintained by the New Jersey Division of Local Government Services.
(4) 
No mercantile license shall be issued without applicant furnishing proof that applicant is in compliance with these ordinance provisions concerning liability insurance.
C. 
Enforcement. The City of Margate may enforce the registration provisions provided in N.J.S.A. 40A:10A-1 et seq and this section through a summary proceeding pursuant to the Penalty Enforcement Law of 1999, P.L. 1999, c. 274 (N.J.S.A. 2A:58-10 et seq.) a fine of not less than $500 but no more than $5,000 against an owner who failed to comply with the provisions of this Act.

Application for a license shall be made to the City Clerk of the City of Margate City, New Jersey, and no license shall be granted until the payment for the same shall have been made. Every license shall specify by name the person to whom it shall be issued, the business for which it is granted and the location at which such business is to be carried on and any conditions of operation as shall have been imposed by Planning Board site plan approval. The license shall be prominently displayed at the place of business.

All license fees shall be due and payable to the City Clerk of the City of Margate City at his office in the City Hall, Margate City, New Jersey. License fees for the remainder of 1993, July 1 to December 31, shall be 1/2 the fees as set forth in this chapter. Commencing January 1, 1994, the full annual fee for the period of January 1 to December 31 will be due and payable in accordance with this chapter.

Any person dealing or intending to deal at any one location in more than one class of goods, wares or merchandise shall pay a license fee which shall combine the fees for each such use.

The license fees to be paid annually, as above provided, to the City of Margate City for conducting the businesses herein named at the places to be designated on the license certificate issued therefor, or for the use of any wagon, vehicle, stand, store or place or thing for the sale of any goods or thing or for the type of service hereinafter designated, shall be as follows:

All licenses issued between the first day of January and the first day of July, following, in any year shall be issued for 1/2 of the fees mentioned hereinabove. Said license shall expire on the 30th day of June, following. Interpretations of category or combined categories of store/business shall be the sole responsibility of the Margate City Clerk.[1]

Any person violating any provision of this chapter shall, upon conviction in the Municipal Court of the City of Margate City, be subject to a fine not to exceed $1,000 or imprisonment in the county jail for any term not to exceed 90 days, or both, in the discretion of the Judge hearing the same.
