A. 
All officers and employees in the classified service of the Township (as "classified service" is defined and construed pursuant to applicable civil service laws and regulations), except professionals appointed or employed by the Township or by any board or agency of the Township, officers and employees exempt by law from residency requirements and those officers and employees otherwise exempted from the provisions of this article by law, hereafter appointed shall be bona fide residents of the Township.
B. 
All applicants for appointment as a police officer shall be residents of the Township of Moorestown and shall maintain continuous residency within the Township of Moorestown from the announced closing date of the New Jersey Department of Personnel examination up to and including the date of appointment.
A. 
Whenever any officer authorized pursuant to Chapter 6, Administration of Government, to make appointments to fill positions or employments within the Township (hereinafter the "appointing authority") shall determine that there cannot be recruited a sufficient number of qualified residents for available specific positions or employments, the Township shall advertise for other qualified applicants. The appointing authority shall thereupon classify all qualified nonresident applicants for such positions and employments as follows:
(1) 
Class A: other residents of Burlington County.
(2) 
Class B: other residents of counties contiguous to Burlington County.
(3) 
Class C: other residents of the State of New Jersey.
(4) 
Class D: all other applicants.
B. 
The appointing authority shall first appoint all those in Subsection A(1) and then those in each succeeding class in the order above listed and shall appoint a person or persons in any such class only to a position or positions or employment or employments remaining after all qualified applicants in the preceding class or classes have been appointed or have declined an offer of appointment.
Whenever the appointing authority shall determine that there are certain specific positions and employments requiring special talents or skills which are necessary for the operations of the Township and which are not likely to be found among the residents of the Township, such positions or employments so determined shall be filled without reference to residency. The criteria pursuant to which such positions and employments shall be so determined are as follows:
A. 
Any position or employment, the services of which are specialized and qualitative in nature.
B. 
Any position or employment which requires expertise and extensive training.
C. 
Any position or employment, the services of which will be required to be performed by an individual who has a proven reputation in the particular field or endeavor.
D. 
Any position or employment, the talents, skills, services or other important characteristics of which cannot be reasonably described by written specifications.
E. 
Any position or employment, the services of which must or foreseeably will be rendered or performed by a person authorized by law to practice a recognized profession or a person whose practice is regulated by law.
F. 
Any position or employment whose performance requires knowledge of an advanced type in a field of learning acquired by a prolonged formal course of specialized instruction and study as distinguished from general academic instruction or apprenticeship and training.
No nonresident officer or employee appointed pursuant to this article shall be required to become a resident as a condition of his or her continued employment.
Officers and employees who are bona fide residents shall be given preference in promotion. When promotions are based upon merit as determined by suitable promotion tests or other objective criteria, a resident shall be given preference over a nonresident in any instance when all other measurable criteria are equal. The preference granted by this section shall in no way diminish, reduce or affect the preference granted pursuant to any other provision of law.
