Township of Moorestown, NJ Chapter 145 Skateboards; Skateboard Ramps

§ 145-1 Unlawful activities.

A. No person shall use or operate or ride on a skateboard upon or in any of the places stated in § 145-2A hereof.

B. No person shall use or operate or ride on a skateboard upon or in any of the places stated in § 145-2B hereof:

(1) In a careless manner without due caution and circumspection; or

(2) While endangering, or in any manner to create a risk or danger to, any person or property; or

(3) In any manner to impede or interfere with pedestrian or vehicular traffic.

C. No person shall place, locate or leave a skateboard ramp in any public roadway (including the entire paved and improved surface thereof, including gutter areas, from curb-to-curb, where curbs exist) or on any public sidewalk in any manner which constitutes a traffic hazard or which endangers or creates a risk to any person or property.

§ 145-2 Restricted areas.

A. The places referred to in § 145-lA are:

(1) All public and private sidewalks, roadways (including the entire paved and improved surface thereof, including gutter areas, from curb-to-curb, where curbs exist), curbs, parking lots, driveways and courtyards within the boundaries shown in Schedule A, annexed, being the portions of East Main Street and West Main Street lying between (and including) the southwesterly side line of Union Street and the northeasterly side line of Chester Avenue and the portions of all real property lots as are shown in Schedule A.[1]

(2) The municipal parking lot fronting on West Second Street (known as "West Parking Plaza"), the municipal parking lot at the Municipal Complex between West Second Street and West Third Street and all sidewalks, curbs, ramps and courtyards at, around, leading to and/ or adjacent to the Moorestown Free Public Library and the Moorestown Town Hall, as set forth in Schedule B, annexed.[2]

B. The places referred to in § 145-1B are all public roadways situate in the Township of Moorestown.

§ 145-3 Definitions.

As used in this chapter the following terms shall have the meanings indicated:

SKATEBOARD

Includes a single platform mounted on wheels designed or suitable or in fact used for riding underfoot, or a board with rollerskate wheels or other similar wheels attached to the underside, without a mechanism or other device for steering while being used, operated or ridden.

SKATEBOARD RAMPS

Include all ramps commonly referred to as such, platforms manufactured or contrived surfaces of any and every pattern or configuration and other similar devices and things designed for use for riding a skateboard upon or above any area.

§ 145-4 Violations and penalties.

A. A police officer of the Township who shall observe any person using, operating or riding upon a skateboard in violation of this chapter shall:

(1) Upon the first violation, take possession of the skateboard for a minimum period of 48 hours, after which the skateboard shall be returned to the parent or guardian of a minor violator or, in the case of an adult violator, to the violator himself.

(2) Upon the second violation, take possession of the skateboard for a minimum of 72 hours and issue a summons and complaint to the violator providing for a fine of $25, payable to the Township Municipal Court in accordance with Subsection B of this section. After said seventy-two-hour period, the skateboard shall be returned to the parent or guardian of a minor violator or, in the case of an adult violator, to the violator himself.

(3) Upon a third violation and upon each subsequent violation, issue a summons and complaint to the violator, returnable before the Township Municipal Court, which shall treat and dispose of such complaint in accordance with Subsection B of this section.

B. Any person violating any provision of this chapter shall, upon conviction, be subject to the penalties set forth in Chapter 66.

C. With respect to every skateboard ramp on a public street or sidewalk which a police officer observes to be a traffic hazard or to endanger or create a risk to any person or property and in violation of this chapter, if the violator or violators of this chapter can be identified and notified immediately, he, she or they shall be given reasonable opportunity to remove the ramp to a lawful place. If the ramp is not so removed within a reasonable time or if the notice cannot be immediately given for any reason, the Township Department of Public Works shall remove the ramp, and, if unclaimed within seven days thereafter, the ramp shall be deemed abandoned and shall be disposed of in accordance with law and township procedures, as appropriate.
