The Township Council hereby finds and declares
that problems of traffic control and congestion occur when traffic
must be moved through or around road, street or highway (roadway)
construction, maintenance operations and utility work (work), above
or below ground, which require blocking the roadway and obstructing
the normal flow of traffic; and that such obstructions are or can
become dangerous when not properly controlled and monitored. In order
to better promote the public health, safety, peace and welfare, it
is necessary to establish controls, regulations and procedures directed
to the safe and expeditious movement of traffic through work zones
and to provide safety for the work forces performing these operations.
The Township Council does hereby adopt the current
Manual on Uniform Traffic Control Devices, 1978 Edition (and any and
all replacement or succeeding editions), hereafter known as "MUTCD,"
except as hereby supplemented and amended and as may be hereafter
supplemented and amended by the Township, as it pertains to the control
and regulation of any work resulting in any delay or obstruction to
the usual and normal flow of traffic on any roadway in the municipality.
Any person, contractor or utility failing to comply with the applicable
provisions of MUTCD, while performing such work shall be in violation
of this section.
A.
Mandatory meeting and approval. It shall be the responsibility
of the person, contractor or public utility wishing to conduct work
on, under or above the roadway to contact the Moorestown Department
of Police in order to arrange a preconstruction meeting to submit
plans for the safe and expeditious movement of traffic during the
period of any work. Said plans must be approved by the Moorestown
Department of Police. Any person, contractor or utility failing to
comply with this section prior to the start of such work when his
plans are not approved by the Moorestown Department of Police is in
violation of this section.
B.
Exception. Public utilities conducting routine maintenance
work which shall take less than two days to complete need not comply
with the preconstruction meeting requirement.
In every case, prior to the start of any work,
the person, contractor or utility shall provide the Moorestown Department
of Police with at least two emergency contact telephone numbers to
be called in case of emergency problems at the work site. If for any
reason emergency contacts cannot be reached or if the emergency contact
person does not immediately respond to and correct the emergency problem
or hazardous condition or if the circumstances are such that the Township
must take action prior to contacting such emergency contact person,
the Township may correct such problem or emergency condition. The
fees, charges and costs for any such services performed by the Township
shall be charged to the person, contractor or utility responsible,
and such fees, charges and costs shall be immediately paid by such
person, contractor or utility.
The Moorestown Department of Police shall maintain
a list of all roadways which it determines to be heavily traveled
for the purposes of this article. Said list may be amended from time
to time by the Moorestown Department of Police, as conditions warrant,
and may include roadways which become heavily traveled due to temporary
conditions or events. Said list shall be available for inspection
at the Moorestown Town Hall during normal business hours, and a copy
of said list shall be provided upon request of any person.
A.
In general. There shall be no work under, on or above
any heavily traveled roadway in the Township before the hour of 9:00
a.m. nor after the hour of 4:00 p.m. on any day. There shall be no
work under, on or above any other roadway in the Township before the
hour of 7:00 a.m. nor after the hour of 6:00 p.m. on any day.
Neither road closings nor traffic detours shall
be permitted unless approved in advance by the Moorestown Department
of Police.

Whenever the Moorestown Department of Police
determines that it is necessary for the safe and expeditious movement
of traffic in, around or by any work site, the person, contractor
or utility responsible for such work shall post an appropriate number
of traffic directors at such site, the appropriate number of such
traffic directors to be decided by the Chief of the Moorestown Department
of Police.
The Moorestown Department of Police shall have
the authority to order any and all work on any roadway project to
be immediately halted, as the need arises, in the discretion of the
Moorestown Department of Public Works. Such authority shall include,
but shall not be limited to, the authority to order the removal of
equipment, vehicles and stored material within the roadway right-of-way,
the backfilling of open excavations and/or other related work in order
to abate any nuisance, traffic delay or safety hazard or for any violation
of this article.
A.
In the case of emergency work which will obstruct,
delay, interfere with or detour traffic on any roadway in the Township,
the person, contractor or utility performing such emergency work shall
notify the Moorestown Department of Police in advance of beginning
such emergency work and receive therefrom approval therefor.
B.
All such emergency work shall be performed with due
regard for public safety and without unnecessarily interfering with
the normal path and flow of traffic. During the course of completing
such emergency work, the person, contractor or utility responsible
for such work shall comply with the provisions of the MUTCD.
