All that certain code entitled the "Public Health Nuisance Code of New Jersey (1953)," approved September 16, 1953, by the State Department of Health for adoption by reference by local Boards of Health be and the same is hereby adopted and established in and for said Township of Moorestown by reference to said code pursuant to the N.J.S.A. 26:3-69.1 to 26:3-69.6. A copy of said code, annexed hereto, be and the same is hereby made a part of this article without setting forth at length herein the text of said code.

Three copies of said Public Health Nuisance Code of New Jersey (1953) have been placed on file in the office of the Township Clerk in the Town Hall of said Township of Moorestown upon the introduction of this article and shall remain on file therein for the use and examination of the public as long as this article shall be in effect. Printed copies of this chapter and said code shall be made available to citizens upon request.

Any person who violates or neglects to comply with any provision of this article or the above-mentioned code established herein or notice issued pursuant thereto shall, upon conviction thereof, be liable to a penalty of not more than $500 for each violation.

This article shall be known as "Feeding of Waterfowl."
As used in this article, the following terms shall have the meanings indicated:
FEED
Includes the provision or dissemination of food in any manner in the vicinity of waterfowl.
WATERFOWL
A general term referring to all undomesticated birds commonly known as "geese," "ducks," "brants," โ€swans," "river and sea ducks," "gulls" and similar species.
WATERWAYS
A general term referring to lakes, ponds, streams, creeks and stormwater basins.
A.ย 
It shall be unlawful for any person to feed waterfowl on any publicly owned land or waterways within the Township.
B.ย 
It shall be unlawful for any person to feed waterfowl on any privately owned/nonresidential land or waterways which are publicly accessed within the Township.
C.ย 
It shall be unlawful to refuse to post a sign on any privately owned/nonresidential property which is publicly accessed if so directed by the Township Manager or Police Department.
A.ย 
When directed to post signs by the Township Manager or Police Department, signs must be conspicuously placed, at the property ownerโ€™s expense, and be constructed not less than 12 inches by 18 inches in size, bearing the words: โ€œWARNING: FEEDING OF WATERFOWL PROHIBITED.โ€
B.ย 
Defacing, tampering, moving or damaging such signs shall constitute a violation of this article.
A.ย 
This article shall be enforced by the Moorestown Township Police Department.
B.ย 
Notice of violation shall be by issuance of Municipal Court summons.
A.ย 
Any person violating this article shall be subject to a warning for the first violation. It is not the intent of the Township to penalize people for feeding waterfowl but to discourage people from doing so.
B.ย 
A person violating this article for a second and subsequent time shall be subject to fine of not less than $25 nor more than $100, or a period of community service, within the meaning and limits of and as referred to in N.J.S.A. 40:69A-29, as amended and supplemented, and other applicable law; or both a fine and community service.
