Editor's Note: This ordinance also repealed
former Ch. 208, Sewage Disposal Systems, Individual, adopted by the
Board of Health 11-16-1964 by Ord. No. H-13, as amended 3-13-1989
by Ord. No. 1464-89.
The Burlington County Health Department shall
be the administrative authority to exercise the powers prescribed
by this article, except that the license to operate an individual
subsurface sewage disposal system shall be issued by the Township
Department of Community Development, and as further excepted by other
sections of this article.
Pursuant to the authority contained in N.J.S.A.
26:3-69 through 26:3-69.6, the Board of Health of this Township does
hereby adopt the new rules and standards governing individual subsurface
sewage disposal systems set forth in N.J.A.C. 7:9A et seq., as an
ordinance operative within the Township of Moorestown regulating construction
and use of individual subsurface sewage disposal systems within this
Township. A copy of the code is hereby incorporated by reference and
made a part of this article without full inclusion of the text thereof
herein.
The code adopted by this article is described
and commonly known as the "Standards for Individual Subsurface Sewage
Disposal Systems."
Three copies of said Standards for Individual
Subsurface Sewage Disposal Systems have been placed on file in the
office of the Township Clerk upon introduction of this article and
will remain on file there for the use and examination of the public.
The following provisions shall be added to and
shall supplement and amend the Standards for Individual Subsurface
Sewage Disposal Systems:
A.
Section 7:9A-3.6 entitled "Witnessing of Soil Evaluation
and Testing," shall be amended to require written notice to the administrative
authority at least 15 business days prior to any soil evaluation and
testing. The administrative authority shall not waive the witnessing
of the excavation of soil profile pits and borings.
B.
Minimum required separation distances.

Table 4.3, at N.J.A.C. 7:9A-4.3, entitled "Minimum
Required Separation Distances (feet)," shall be amended to require
the following minimum separation distances between any septic disposal
field and the following components:

Except as otherwise amended above, the table set forth
at N.J.A.C. 7:9A-4.3, Table 4.3, shall remain in full force and effect.
C.
Section 7:9A-4.7, entitled "Freshwater Wetlands,"
shall be amended to prohibit the location of any individual subsurface
sewage disposal system in any freshwater wetland and freshwater wetland
transition area.
D.
Section 7:9A-5.8(b)2, entitled "Criteria for Recognition
of Zones of Saturation," shall be revised to require that any evaluation
of soil for the purpose of determining the estimated seasonal high
groundwater table, pursuant to the standards adopted by reference
herein, shall be conducted only in the months from January through
April, inclusive.
E.
A lot area of not less than 1.5 acres shall be required
for the construction of an individual subsurface sewage disposal system.
Lots containing at least one acre in area and legally existing on
September 1, 1991, shall be exempt from this requirement.
F.
The slopes
on mounded systems are to be a minimum of 5:1.

G.
Pressure-dosing
systems shall have a minimum size of 1.61 square feet of bottom area
per gallon of daily sewage volume.

H.
Septic
systems shall be designed/sized to accommodate garbage disposals,
even if installation is not immediately planned.

I.
If, during
construction of a septic field, tile drains are encountered, the tile
drains are to be removed to the property line or to 100 feet from
the outside of the septic field, whichever limit is encountered first.

The administrative authority may order all further
work in and about any individual sewage disposal system that is being
erected or installed in violation of the code to be stopped forthwith,
except such work as shall be necessary to remedy such violation and,
thereafter, the work continued without any violation of any of the
provisions of the code; and after issuance of any such order and the
service of a copy thereof upon any person connected with or working
in and about the erection or installation of any such disposal system
or any part thereof, no further work shall be done thereon except
as aforesaid.
In case any certification is denied by the administrative
authority, a hearing shall be held thereon before the Township Manager
within 15 days after the request thereof is made by the applicant.
Upon such hearing, the Township Manager shall affirm, alter or rescind
the previous administrative authority's determination and take action
accordingly within 15 days after the date of such hearing. The Township
Manager shall take into consideration the reports of the administrative
authority and the Township Engineer in making a decision.
