A certain document, three copies of which are on file in the office of the Secretary of the Borough of Bridgeport, being marked and designated as the "BOCA Basic Fire Prevention Code, 1981 Edition," published by the Building Officials and Code Administrators International, Inc., is hereby adopted as the Fire Prevention Code of the Borough of Bridgeport, Commonwealth of Pennsylvania, for the control of buildings and structures or parts of both, as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of the said BOCA Basic Fire Prevention Code are hereby referred to, adopted and made part hereof, as if fully set out in this article with the additions, deletions or changes, if any, prescribed in § 175-2 of this article.
A. 
Additions.
(1) 
Section F-100.1, Title, is amended by inserting the name "Borough of Bridgeport" in the second line.
B. 
Modifications.
(1) 
Section F-104.1, Appeals, is hereby modified as follows:
F-104.1 Appeals: Appeals to the Board may be taken by any person aggrieved by any decision or interpretation by the fire officials made under the provisions of this code. The Board of Appeals shall consist of the entire membership of the Borough Council of the Borough of Bridgeport, which Board may adopt reasonable rules and regulations for conducting hearings, all of which shall be done in accordance with the Local Agency Law of the Commonwealth of Pennsylvania.
C. 
Deletions.
(1) 
The following Articles are deleted:
(a) 
Article 6, Airports, Heliports and Helistops.
(b) 
Article 11, Fruit Ripening Processes.
(c) 
Article 27, Explosives, Ammunition and Blasting Agents.
(d) 
Article 28, Fireworks.
(2) 
The following sections are deleted:

(a) 
Section F-102.1, Enforcement Officer, shall be deleted in its entirety.
(b) 
Section F-102.2, Inspections, shall be deleted in its entirety.
A. 
Nothing contained in this article or in the BOCA Basic Fire Prevention Code, 1981 Edition, adopted hereby shall be construed to affect any suit or proceeding pending in any court or any rights acquired or liabilities incurred or any cause or causes of actions acquired or existing under the Act or ordinances repealed by this article, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
B. 
The recital of various uses and types of processes, occupancy and equipment as set forth in Articles 6 through 21 in Part B of the BOCA Basic Fire Prevention Code, 1981 Edition, and the recital of materials handling in Articles 22 through 34 in Part C of the BOCA Basic Fire Prevention Code, 1981 Edition, shall not be construed as authorizing any of the uses, processes, occupancies, equipment and materials set forth therein, said entitlement to utilize premises in such manner and implement the processes as described therein, being subject to the valid zoning laws of the Borough of Bridgeport.[1] Such recital as aforesaid shall not be construed as approval by Borough Council of the types of uses set forth therein or a recognition by Borough Council as to the necessity for or desirability for said uses or systems being made within the Borough limits.

Any person, partnership, association, corporation, joint venture or other entity who or which shall violate any provisions of Ordinance No. 478 or 480 of the Borough of Bridgeport[1] or shall fail to comply with any of the requirements of either ordinance or who or which shall deviate from or violate the terms of any permits or permissions granted thereunder shall be guilty of a summary offense and, upon conviction thereof, shall be subject to a fine of not more than $1,000 or, in default thereof, shall be subject to imprisonment for a period not to exceed 30 days. Each day of continued violation shall constitute a single and separate offense.
