State Highway Route 143 (U.S. Traffic Route 202 -
DeKalb Street).
[Added 4-12-1983 by Ord. No. 472, approved 4-12-1983]
(1)
Weight limit. No vehicle shall use, cross or encroach
upon the bridge carrying State Highway Route 143 (U.S. Traffic Route
202 - DeKalb Street) over and above the grade of two tracks of the
Southeastern Pennsylvania Transportation Authority in the Borough
of Bridgeport unless the weight of the vehicle, including any attachments,
trailers or cargos, does not exceed nine tons. The maximum load limit
for any vehicle, including any attachments, trailers or cargo of said
vehicle, shall be nine tons when using, crossing or encroaching upon
said bridge. School buses, emergency vehicles and vehicles making
local deliveries or pickups within the Borough of Bridgeport shall
be exempt from restrictions on the use of the said bridge imposed
under this subsection.
(2)
Violation; summary offense. Any person operating a
vehicle or combination upon the bridge carrying State Highway Route
143 (U.S. Traffic Route 202 - DeKalb Street) over and above the grade
of two tracks of the Southeastern Pennsylvania Transportation Authority
in violation of this subsection is guilty of a summary offense and
shall, upon conviction, be sentenced to pay a fine not exceeding $150
for each 500 pounds or part thereof in excess of 3,000 pounds over
the maximum allowable weight of nine tons.
(3)
Posting security for fine and costs. Upon the arrest
of any person for a violation of this subsection, the vehicle which
was involved with the violation shall be rendered temporarily inoperative
by the Police Department of the Borough of Bridgeport. Upon the posting
of an amount equal to the fine and costs or other appropriate security
as approved by the Magisterial District Judge for the Borough of Bridgeport,
the vehicle shall be released to the operator thereof. In the event
that the fine and costs or other appropriate security is not posted
within 24 hours after the arrest, the vehicle shall be impounded by
either the Sheriff of Montgomery County or a constable for the Borough
of Bridgeport, as directed by the Magisterial District Judge. The
impoundment shall continue until the first of the following occurs:
(4)
Notice. If the vehicle is impounded under the terms of Subsection B(3), the Police Department of the Borough of Bridgeport shall give immediate notice by the most expeditious means and by certified mail, return receipt requested, of the impoundment and location of the vehicle or combination to the owner of the vehicle or combination and to the owner of the load if the name and address of the owner are known or can be ascertained by the Police Department.
(5)
Recoverable costs. The costs of the impoundment, as
well as any costs of sale of any item as set forth in this subsection,
including reasonable storage fees and other reasonable costs incident
to the seizure, impoundment and sale, shall be recoverable in addition
to the cost of prosecution.
(6)
Load. The title to the load on an impounded vehicle
or combination remains in the owner, who may repossess the load at
any time upon presentation of proof of ownership to the Police Department.
If the load spoils during impoundment, the loss shall be on the owner,
subject to any right of recovery of damages that the owner may have
against the owner of the vehicle or combination or against any other
party, and the cost of disposition of the load shall be recoverable
in addition to the cost of prosecution.
(7)
Sale of unclaimed vehicle or load. In case any impounded
vehicle or combination is unredeemed, or the load is unclaimed, for
a period of 60 days after notice of impoundment is given, it shall
be sold at a public sale by the Sheriff or constable, as determined
by the Magisterial District Judge, upon order of the issuing authority
and after 10 days' notice of the sale to the owners, lienholders or
secured parties of the vehicle or load, except that, if the Sheriff
or constable determines it to be necessary to preserve their value,
goods which may spoil may be sold in any commercially reasonable manner
prior to expiration of the sixty-day period and, if impractical to
do so, without giving notice to the owners, lienholders or secured
parties.
(8)
Disposition of proceeds of sale. The proceeds of sale
shall first be applied to the payment of the fine and costs, as defined
herein, and secondly to the payment of the encumbrances, with the
remainder being paid to the owner of the vehicle.
C.
Truck traffic, with the exception of local deliveries,
shall be prohibited on the following streets or parts of streets.
