The proper officers of the Township are hereby authorized and directed to execute and deliver on behalf of the Township the intergovernmental cooperation implementation agreement (the "agreement"), in substantially the form attached hereto as Exhibit "A,"[1] with respect to the implementation of the aforementioned Regional Comprehensive Plan dated June 2005 for Coolbaugh Township, Tobyhanna Township, Tunkhannock Township and the Borough of Mount Pocono.

The agreement shall be valid, effective and enforceable for and against all parties thereto for an indefinite term. Each party to the agreement may, upon the requisite ninety-day written notice to the other parties, withdraw from the agreement. Each participating municipality shall be required to adopt a resolution authorizing each withdrawal.
The agreement is intended to authorize the participating municipalities to implement the above-referenced Regional Comprehensive Plan for Coolbaugh Township, Tobyhanna Township, Tunkhannock Township and the Borough of Mount Pocono. The participating municipalities, by way of the agreement, intend to and have agreed to amend their respective ordinances to be consistent with the aforementioned Plan.
The agreement permits each participating municipality to review and provide advisory comments on pending subdivision and land development plans within the other participating municipalities. The participating municipalities may also review and comment on proposed subdivision and land development ordinance that are being considered for adoption by the other participating municipalities. The agreement requires each participating municipality to notify the other participating municipalities of all pending subdivision and/or land development plans of regional significance within said municipalities and further requires the participating municipalities to notify all other participating municipalities of subdivision and land development ordinances that are being considered for adoption.
The agreement states that all of the participating municipalities shall maintain their own planning commission and zoning hearing board and may either maintain their own subdivision and land development and zoning ordinances, or may adopt said ordinances jointly with other participating municipalities.
The agreement requires the Plan to be reviewed and/or updated at least once every 10 years.
The proper officers of the Township are hereby authorized and directed to take all such actions, execute, deliver, file and/or record all such documents, publish all notices and otherwise comply with the provisions of this article and the Act insofar as the transaction contemplated by this article, in the name and on behalf of the Township.
