Every grave wherein any dead human body is to
be buried or interred, in any cemetery or burying ground within the
limits of the Borough of Totowa, shall be so made and constructed
that the top of the outside coffin shall be at least four feet beneath
the natural surface of the ground and shall be immediately covered
with at least four feet of earth, soil or sand, except only the bodies
of infants in boxes not more than four feet in length, which shall
be so buried or interred that the top of the outside box enclosing
them shall be at least three feet six inches below the natural surface
of the ground, and they shall be immediately covered with at least
three feet six inches of earth, soil or sand, provided that this shall
not apply where bodies are placed or buried in private vaults or tombs,
properly constructed so as to prevent the escape of noxious or unhealthy
gases therefrom.

No dead human body shall be disinterred or removed
from any grave, tomb or burial place within the limits of the Borough
of Totowa, except by jurisdiction of a competent court of this state,
for the purpose of criminal investigation or upon permit being given
by the Board of Health therefor in accordance with the statutes of
the State of New Jersey.
B.Â
No dead body of a person who has died of smallpox,
cholera, yellow fever, typhus fever, plague or from any disease publicly
declared by the State Department to be communicable shall be disinterred
or removed from any grave, tomb, vault or place within the limits
of the Borough of Totowa unless the body was originally interred in
a metallic case, hermetically sealed, and then only by the order of
and under the direction of the Board of Health. The requirement as
to the use of a metallic case shall not apply where the body has been
embalmed prior to burial and buried or interred three years or more.
The person in charge of any cemetery, burial
ground or premises on which an interment is made shall endorse, over
his signature, upon the burial, removal or transit permit as required
by the statutes of the State of New Jersey, the date of interment,
and shall return the permit so endorsed or the detachable portion
of the transit permit, if any, to the Board of Health within seven
days from the date of interment.
The Board of Health and its Cemetery Inspector
or other authorized agents may at all times enter any cemetery or
burial ground within the limits of the Borough of Totowa for the purpose
of examining the condition of the same and ascertaining whether all
local or state laws regulating it are duly observed.[1]

A fee of $2 shall accompany every burial, removal or transit permit returned to the Board of Health in accordance with § 433-3, and any permit not so accompanied will not be accepted by the Board, and the person or persons returning the same shall be deemed not to have complied with the requirements of § 433-3. This fee shall be to cover the costs of inspection and investigation by the Cemetery Inspector and other authorized personnel of the Board of Health, the printing of any and all necessary forms, the filing of the permits and the keeping of records.
All fees, penalties and moneys collected under
any provision of this chapter shall be paid to the Treasurer of the
municipality.
