This chapter shall be known and may be cited
as the "Village of New Haven Off-Street Parking Regulation Ordinance."
From after the effective date of this chapter,
all properties used or proposed to be used for off-street parking
purposes consisting of three or more parking spaces shall be evaluated
by the Village Police Chief, Fire Chief and Department of Public Works
Superintendent and such other Village Council-appointed representative
as may be deemed necessary. An evaluation report shall be submitted
by each official covering principal points of concern as follows:

Police Chief.
(1)
Relationship of entry and exit points to Village streets
and recommendations for relocation or disapproval if hazardous conditions
have or will be created with regards to traffic movement.
C.
Department of Public Works Superintendent.
(1)
Effects of surface drainage caused or anticipated
to occur from location of parking area.
(2)
Relationship of surface construction or proposed surface
construction to adjacent public street surfaces and effect, if any,
thereon. Of particular concern shall be the effect of gravel surface
parking areas adjacent to bituminous paved street surfaces and resultant
damage that occurs by vehicular passage from the gravel area to the
paved area.
(3)
Adequacy of the area with regard to the cleaning of
snow and removal from or storage on the premises.
A.
From and after the effective date of this chapter,
all off-street parking areas existing or proposed containing three
or more parking spaces shall be licensed by the New Haven Village
Council and shall be designed and modified if necessary to avoid traffic
congestion and hazardous traffic conditions. The design for newly
constructed parking lots or modification of existing parking lots
shall be subject to engineering review and approval and be in accordance
with the standards set forth as follows:
(1)
Minimum base material: six inches compacted thickness
Michigan State Highway Department current specification 22A road gravel.
(2)
Minimum surface material: 2 1/2 inches compacted
thickness Michigan State Highway Department current specification
412 hot mix asphalt or approved equal.
(3)
In lieu of the foregoing base and surface materials:
A minimum of five inches portland cement concrete of No. 3,500 mix
or five inches of full-depth hot mix asphalt pavement Michigan State
Highway Department specifications 411 or 412 may be substituted where
satisfactory subbase material is encountered.
(4)
Parking spaces shall be laid out with minimum dimensions
of nine feet by 20 feet.
(5)
Adequate space for maneuvering lanes and entrance
and exit shall be provided, and construction shall be in accordance
with the same specification approved for the parking lot.
B.
All licenses once issued shall remain in force and
effect so long as the property licensed is used for off-street parking
and remains in compliance with the requirements of this chapter.
C.
All persons, firms, corporations or other entities
using or planning to use areas for off-street parking purposes shall
make application for such permits within 60 days following the effective
date of this chapter.
D.
Applications for permits shall contain the following
information: name of owner; date of application; address of owner;
address of property or legal description; number of parking spaces;
location of entry and exit points in relation to streets outlined
on a site drawing, including North point and type of surfacing existing
and/or proposed.
E.
Licenses will be issued at no cost to owners or lessors.
All off-street parking areas licensed under
the provision of this chapter shall be inspected at least once a year
by the DPW Superintendent and such other officials as deemed necessary
by the Village Council, and a report as to adequacy and maintenance
thereof shall be filed with the Village Clerk.

Any person, firm or corporation or other entity or anyone acting on his or its behalf who shall violate any of the provisions of this chapter shall, upon conviction thereof, be subject to the penalties set forth in Chapter 59, Municipal Civil Infractions, of the Code of the Village of New Haven. Each day that a violation is permitted to continue shall constitute a separate offense.
