Alcoholic beverages — See Ch. 47.
Pursuant to the powers conferred on the Town Council by the provisions of MGL c. 138, §§ 12, 14 and 23, and all other powers the Council may have, the Council hereby adopts the following rules and regulations for persons holding alcoholic beverage licenses within the Town of Franklin.[1]

As used in this chapter, the following terms shall have the meanings indicated:
BAZAAR
A function disposing of cash awards or merchandise by means of chance, including, without limitation, so-called Las Vegas, Casino or Monte Carlo nights; provided, however, that the term shall not be deemed to include the conduct of the games commonly known as "beano," "whist" or "bridge" or the sale of lottery tickets or raffles to the extent otherwise authorized by law.
No bazaar shall be conducted on licensed premises in violation of MGL c. 271, § 7A, and, if applicable, 961 CMR 4.00 et seq.
A licensee shall not allow the conduct of a bazaar on the licensed premises unless he has delivered written notice of the bazaar to the Town Council at least 30 days prior to the date on which the bazaar is to be held. Such notice shall include:
A. 
The date and time of the bazaar.
B. 
The name of the sponsoring organization and the name and address of the member of such organization in charge of the conduct of the bazaar.
C. 
The terms and conditions of the agreement between the sponsoring organization and the licensee relating to the use of the licensed premises.
D. 
An identification of the room or portion of the licensed premises to be used for the bazaar.
E. 
A copy of the lease or other agreement between the sponsoring organization and any person or organization furnishing any equipment for the conduct of the bazaar.
F. 
A copy of the organization's bazaar permit.
In addition to any other applicable rules and regulations, the following rules shall apply to the conduct of the bazaar:
A. 
Each worker shall wear a badge stating the name of the worker and the name of the sponsoring organization.
B. 
No person under the age of 20 years shall be allowed in the portion of the premises in which the bazaar is conducted.
C. 
The bazaar shall be limited to five consecutive hours terminating no later than 1:00 a.m.
D. 
Only organizations with a principal place of business in the Town of Franklin shall be permitted to sponsor bazaars.
E. 
The promotion and operation of the bazaar shall be confined solely to the qualified members of the sponsoring organization, and no such member shall receive remuneration in any form for time or effort devoted to the promotion or operation of the bazaar.
F. 
Except as authorized by the Town Council in writing for good cause shown, the services of a police officer shall be retained, and such officer shall be in attendance from the time admission to the bazaar commences until the proceeds from the bazaar have been secured.
No licensee shall have more than two bazaars conducted on its licensed premises in any calendar year. For the purposes of these regulations, each day a bazaar is held shall be considered a separate bazaar.
Conduct of a bazaar on licensed premises in violation of these regulations shall be cause for suspension or revocation of the alcoholic beverage license. To assure compliance herewith, the licensed premises shall be subject to inspection by the Town Council and its agents.
