All commercial and industrial solid waste dumpsters within the Town of Franklin shall be approved for public health and sanitary purposes by the Board of Health members, or its agent, for location, construction, proper closures and screening.
Open top dumpsters shall be enclosed with a fence composed of wood, lattice, fine mesh fencing or other suitable material as determined by the Board of Health, with a minimum height of three feet above the top of the container. Dumpsters with attached lid tops will not require enclosures and shall be tightly closed or secured at all times. Rubbish or debris, bagged or otherwise on the ground, shall not be allowed.
A. 
This regulation shall apply to all dumpsters servicing any habitable dwelling, commercial and/or industrial building.
B. 
The location of dumpsters shall conform to state and local fire codes.
Dumpsters located within the Town of Franklin for construction purposes for a period not to exceed six months shall not be affected by this chapter, provided that the overflow is not spilled in the area of the site.
Penalties for violation of this chapter shall be in accordance with MGL c. 111, §§ 187 and 188, or any other penalty clauses adopted by this Board.
