Uniform Fire Safety Code — See Ch. 104, Art. I.
There is hereby established in the Borough of Pennington a Fire District designated as follows: the Commissioners of the Fire District in the Borough of Pennington, County of Mercer.
The legal voters of the Fire District aforesaid shall, by ballot, determine the amount of money to be raised for the ensuing year and elect a Board of Fire Commissioners to consist of five persons, all pursuant to the provisions of N.J.S.A. 40A:14-70 et seq. The said Board of Fire Commissioners shall be responsible for the administration of the Fire District as provided by law.
A. 
The Board of Fire Commissioners shall annually submit to the voters of the district the amount determined by the Board to be raised for the budget of the district for the ensuing year. Such election shall be upon notice as provided by law and shall include in such notice the amount of the budget to be voted upon. The legal voters of the district shall determine at such election, by a majority vote of those voting upon the proposition, whether to approve the budget as stated or to reject the same.
B. 
If the voters reject the budget submitted at the annual election, the Borough Council shall, after consultation with the Fire Commissioners, determine the amount, which in the judgment of the Borough Council is necessary for the budget of the district for the ensuing year. The Borough Council shall render such determination within 45 days of receipt of the rejected budget from the Commissioners. Upon determination of the amount of the budget, the Borough Clerk shall certify the same to the Assessor.
Fire District of the Borough of Pennington is described as follows: all lands within the physical boundaries of the Borough of Pennington as the same may exist from time to time.
