It is in the intention of this chapter that
the Borough of Pennington's parks, playgrounds and recreation areas
be reserved to the residents of the Borough of Pennington and the
residents of the surrounding area and that the use of said facilities
shall have minimal necessary standards to ensure the health, safety
and welfare of all citizens who may desire to use said facilities.
As used in this chapter, the following terms
shall have the meanings indicated:
Includes dogs, cats, horses or any other domesticated living
creatures.
The Borough of Pennington.
Any park, playground or recreation area maintained by the
Borough of Pennington.
Any written license issued by or under the authority of the
Borough Council permitting a special activity or event on park property.
Any natural person, corporation, company, association, joint-stock
association, firm, copartnership or unincorporated association of
individuals.
Includes any motor vehicles, trailers, campers, go-carts,
snowmobiles, motorcycles or motorbikes, or other vehicles propelled
by other than muscular power.
A.
No animals shall be allowed to run at large within
the parks of the Borough. Any animals being brought into the park
facilities shall be restrained by appropriate leashes or otherwise
under full control.
B.
No person shall cut, injure, deface, remove or disturb
any tree, shrub, building, fence, bench, barbecue or any other structure
owned or erected by others in the parks of the Borough; nor shall
any person pick, cut or remove any shrub, brush or flower nor mark,
write, paint or in any way deface any building fence, bench or other
structure within the park area, it being the expressed intention of
this chapter that those persons who use the Borough parks leave them
in the same condition in which they found them.
C.
No person shall make or kindle an open fire in any
area other than those set forth for barbecuing by the Borough or in
containers or grills brought by the person to the park for the purpose
of a barbecue.
D.
No person shall bring any intoxicating liquors or
beverages into the parks.
E.
No organization (whether formal or informal) or group of people of 25 or more shall utilize the park facilities without first obtaining a permit as provided in § 143-4 hereof.
F.
No person shall remain in any park between the hours
of dusk and sunrise, except by special permit.

G.
No person shall sell or offer for sale any object or merchandise or any other thing within the park, without first obtaining a permit as provided in § 143-4 hereof.
H.
No person shall operate any vehicle within the confines
of any Borough park. Motor vehicles may be parked only in the designated
motor vehicle parking area.
I.
No person shall smoke or be in possession of a lighted cigar, cigarette,
pipe or other matter or substance which contains tobacco or any other
matter which is lighted or burning for the purpose of inhaling the
smoke; consume smokeless tobacco; or use an electronic nicotine delivery
system.

A.
Permits shall be issued by the Borough Clerk upon
written application and payment of the fees set forth herein. No permit
shall be issued prior to the Clerk notifying the Pennington Borough
Police Department of the permit application. Any appeal regarding
the refusal to grant a permit shall be heard by the Borough Council
after notice to all interested parties.

B.
Permits shall be issued upon the payment of the fee provided in Chapter 98 of this Code.

C.
The Borough may set forth conditions with regard to
the issuance of a permit if it feels that the intended use so warrants.
All conditions of the permit approval must be adhered to and any violation
of the terms and conditions, rules and regulations, or falsifications
shall constitute grounds for revocation of the permit.
D.
All permit applications must be submitted at least
10 days prior to the day for which the permit is sought.
A notice of this chapter shall be posted in
a conspicuous place in each Borough park.

Any person found guilty of a violation of this
chapter shall be subject to a fine not exceeding $1,000, imprisonment
in the county jail for a period not exceeding 90 days or a period
of community service not exceeding 90 days, or a combination thereof.
