The owner or owners, tenant or tenants of lands abutting or bordering upon the sidewalks of the public streets, avenues and highway in the Borough of Pennington shall remove or cause to be removed from the sidewalks in front of or bordering on their lands all snow and ice within 12 hours of daylight after the same shall be formed or fall thereon, provided, that if by reason of low temperature it is impossible to remove such snow and ice, then said snow and ice shall be spread with salt, ashes or sand sufficient to make the same safe for pedestrians until such time as the same can be removed, when said owner or owners, tenant or tenants shall remove or cause the same to be removed as hereinbefore provided.

In case such owner or owners, tenant or tenants of any land abutting or bordering upon any public street, avenue or highway in said Borough shall neglect or refuse to remove such snow and ice within 12 hours of daylight after the same shall have fallen, or formed, or to spread the same with salt, ashes or sand as hereinbefore provided, the Department of Public Works may remove or cause to be removed such snow or ice from the sidewalk in front of or bordering on such land or to spread or cause same to spread or cause same to be spread with salt, ashes or sand as hereinbefore provided.

The cost paid and incurred by the Borough for removing such snow and ice from the sidewalk or for spreading same with salt, ashes or sand, as the case may be, shall be certified to the Mayor and Council of the Borough, which shall examine the certificate and, if found to be reasonable, shall cause such costs to be charged against the abutting lands. The amounts so charged shall thereupon become a lien and tax upon such real estate and be added to and become a part of the taxes next to be levied and assessed thereon. Computation of charges shall be based on the rates set forth in Chapter 98 of this Code:

Such owner or owners, tenant or tenants, for every neglect or refusal to comply with the provisions of this article, shall be subject to a fine not exceeding $1,000, imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof, for such neglect or refusal. Each day that such neglect or refusal continues shall be considered a separate offense.
