A. 
The Canton Trail is intended for the use of the general public engaged in such recreational activities as walking, jogging, bicycling, skating, skiing and sightseeing.
B. 
The provisions set forth in this article are intended to promote the safety and enjoyment of the general public engaged in the recreational use of the Canton Trail.
The Canton Trail shall be open to members of the general public each day according to such schedule as may be established from time to time by resolution of the Canton Village Board of Trustees. The schedule, and any revisions thereto, shall be maintained in the office of the Canton Village Clerk.
For the purpose of this article, the following definitions shall control:
BICYCLE
Every two- or three-wheeled device upon which a person or persons may ride, propelled by human power through a belt, a chain or gears, with such wheels in a tandem or tricycle.
VEHICLE
Any device in, upon or by which any person or property is or may be transported or drawn. This definition shall include, without limitation, bicycles, wheelchairs, roller skates, in-line skates and skateboards.
WHEELCHAIR
Any manual or electrically driven mobility assistance device, scooter, tricycle or similar device used by a person with a disability as a substitute for walking (an "electrically driven mobility assistance device" means any wheeled, electronically powered device designed to enable a person with a disability to move from place to place).
A. 
The following activities and uses shall be allowed upon the Canton Trail:
(1) 
The operation of bicycles;
(2) 
The operation of wheelchairs;
(3) 
The operation of roller skates or in-line skates or skateboards;
(4) 
Hiking, walking, running and jogging; and
(5) 
Cross-country skiing and snowshoeing.
B. 
Except as otherwise expressly permitted by the terms of this article, no motorized vehicle shall be operated by any person or persons upon the Canton Trail. Notwithstanding the foregoing, there shall be allowed access to motorized vehicles for the provision of emergency fire, health and safety or medical service, as necessary, as well as for the maintenance of the trail.
C. 
There shall be allowed no racing on the Canton Trail, unless specifically authorized by the Village Board of Trustees, upon application made by the group or persons organizing/sponsoring the race, and upon such terms or conditions as the Board of Trustees may specify.
D. 
Traffic on the Canton Trail shall proceed in a two-way manner, with each directional flow of traffic to keep to the right side of the Canton Trail.
E. 
Users of the Canton Trail shall conduct their use so as not to interfere or restrict the legitimate or safe use of the Canton Trail by others. Users of the Canton Trail shall follow any posted directions for use which are established by the Village Board of Trustees.
A. 
Except as otherwise specifically set forth in this article, use or operation of any permitted vehicle upon the Canton Trail shall be in accord with the provisions of the New York State Vehicle and Traffic Law. The New York State Vehicle and Traffic Law, as presently stated and as hereafter amended from time to time, is incorporated by reference herein. Without limitation, this provision is intended to require conformity with the New York State Vehicle and Traffic Law rules and regulations dealing with the wearing of protective helmets by the riders, users and operators of bicycles and in-line skates.
B. 
Except as otherwise specifically set forth in this article, use or operation of a bicycle upon the Canton Trail shall be in accord with the rules of Chapter 105 of the Village of Canton Code.
C. 
Notwithstanding the foregoing subsection or § 105-3 of the Village Code, a person may ride or operate a vehicle, otherwise permitted by this article, along the Canton Trail, even though the Canton Trail may be used by a pedestrian. However, no person shall ride or operate any vehicle upon any section of the Canton Trail specifically reserved for pedestrian traffic only.
A. 
Any person who violates the provisions of § 229-4 or 229-5 shall pay a civil fine not to exceed $50 for each such offense.
B. 
The court may waive any fine for which a person who violates the provisions of § 229-5 would be liable if such person supplies the court with proof that between the date of the violation and the appearance date for such violation such person purchased or rented a helmet.
C. 
A summons shall be issued for a violation of § 229-4 or 229-5 by a person less than 18 years of age to the parent or guardian of such person if the violation by such person occurs in the presence of such person's parent or guardian and where such parent or guardian is 18 years of age or more.
