GENERAL REFERENCES
Police Department — See Ch. 56.
As used in this article, the following terms shall have the meanings indicated:
BLOTTER
The official record of the Police Department and will be maintained in a chronological order as the Chief of Police directs.
POLICE DEPARTMENT
All police officers, patrolmen and employees of said Department.
POLICE HEADQUARTERS
Consists of the offices, confinement facilities and other areas allocated for use by the Police Department.
The following Code of Ethics prepared by the International Association of Chiefs of Police and Federal Bureau of Investigation is included as a part of the rules and regulations of this Department:
As a law enforcement officer, my fundamental duty is to serve mankind; to safeguard lives and property; to protect the innocent against deception, the weak against oppression or intimidation and the peaceful against violence or disorder; and to respect the constitutional rights of all men to liberty, equality and justice.
I will keep my private life unsullied as an example to all; maintain courageous and calm in the face of danger, scorn or ridicule; develop self-restraint; be constantly mindful of the welfare of others; and honest in thought and deed in both my personal and official life. I will be exemplary in obeying the laws of the land and the regulations of my Department. Whatever I see or hear of a confidential nature or that is confided to me in my official capacity will be kept ever secret unless revelation is necessary in the performance of my duty.
I will never act officiously or permit personal feelings, prejudices, animosities or friendships to influence my decisions. With no compromise for crime and relentless prosecution of criminals, I will enforce the law courteously and appropriately without fear or favor, malice or ill will, never employing unnecessary force or violence and never accepting gratuities.
I recognize the badge of my office as a symbol of public faith, and I accept it as a public trust to be held so long as I am true to the ethics of the police service. I will constantly strive to achieve these objectives and ideals, dedicating myself before God to my chosen profession - law enforcement.
A. 
The order of rank among personnel of the Police Department will be as follows:
(1) 
Chief of Police.
(2) 
Sergeants by seniority.
(3) 
Patrolmen by seniority.
B. 
Seniority shall be determined by date of appointment to rank and continuous service in the rank.
At the scene of any police activity, the ranking police officer at that location will be in command and responsible for all police activity that is accomplished until an officer of higher rank arrives at the scene.
It is the duty of the Police Department at all times of the day and night to protect life and property, prevent crime, detect and arrest offenders, preserve the public peace and enforce all laws and ordinances over which the Police Department has jurisdiction.
Members of the Department shall present themselves in full uniform with equipment in headquarters five minutes before their tour of duty.
A member of the Department shall operate a Department vehicle to which he is assigned in such a manner as to avoid injury to persons or damage to property. Preventive maintenance and inspections of vehicles will be made in accordance with directives of the Chief of Police.
Members of this Department shall not become a party to any argument, no matter in what degree of guilt he may regard a person who he thinks has violated the law. In all cases of motor vehicle violation, whether for the purpose of issuing a warning or a summons, the registration or owner's card and the driver's license shall be asked for and obtained by the officer after the driver has been advised of the reason for which he has been stopped. In accepting the driver's license and registration, no case or pocketbook shall be accepted by the officer and no driver's license will be accepted until the record of convictions stub has been detached.
Members of the Police Department shall not smoke while on foot patrol or on a traffic control post.
A. 
A member of the Department is responsible for the good care, proper maintenance and serviceable condition of any Department property issued for or assigned to his use.
B. 
A member of the Department shall promptly report to his commanding officer the loss of, damage to or unserviceable condition of any Department property issued for or assigned to his use.
A member of the Department shall not alter police equipment by changing it in any way, except in cases of emergency, unless so directed by his superior.
A member of the Department shall promptly pay his just debts and shall not incur liabilities which he is unable or unwilling to discharge.
Members of the Department shall comply with all civil laws and local ordinances while on or off duty, except as exempted by law while in performance of duty.
A. 
A member of the Department shall promptly obey all lawful orders of his superior officers.
B. 
Members of the Department shall not at any time be insubordinate to any superior officer or uncivil to any other member of the Department.
A. 
All police officers shall be required to attain proficiency in the use of firearms as stipulated by the Chief of Police.
B. 
Except in the line of duty, members of the Department shall refrain from firing their firearms while on duty.
A. 
A member of the Department is responsible for the neatness and cleanliness of his person.
B. 
Members of the Department shall at all times conduct themselves in a gentlemanly manner, especially in their dealings with the public. Being rude, boisterous or discourteous or the use of lewd or profane language to any person or persons, whether such person or persons are under arrest or not, is forbidden. In the event that force is necessary to make an arrest, only such force as is necessary shall be used.
C. 
There must at no time be any criticism made to anyone outside of the Police Department as to the management thereof.
A member of the Department must at no time go to the Mayor or Village Trustees regarding police matters without the expressed permission of the Chief of Police. In an instance where a member of the Department wishes to make a complaint on the manner in which he is being treated by his superiors, he will first discuss the matter with the Chief of Police. If the matter cannot be satisfactorily resolved, the Chief of Police will grant permission for the member to discuss the matter with the Mayor.
Nothing will be purchased and charged to the Police Department or the Village of Canton without first obtaining permission from the Chief of Police to do so.
No personal toll calls shall be made on Police Department telephones.
A member of the Department shall report to his commanding officer any delinquency, dereliction of duty, violation of the rules and regulations, and conduct, disorder and neglect to the prejudice of good order, efficiency and discipline which he observes or of which he has knowledge.
A. 
Daily reports must be finished at the end of the tour of duty.
B. 
All officers shall enter an account of their daily activity on their daily activity reports as prescribed by the Chief of Police.
A member of the Department shall not indulge in intoxicants while in uniform. A member of the Department not required to wear a uniform or a uniformed member while out of uniform shall not indulge in intoxicants to an extent that would make him unfit for duty. Unless in the immediate performance of police duty or with the permission of the Chief of Police, a member of the Department in uniform shall not enter any premises which is used for the manufacture, storage or shipping of intoxicants or any premises where an intoxicant is sold, except for the purpose of eating a meal in a duly licensed hotel or restaurant.
A member of the Police Department shall be fit for, available for and subject to duty at all times, except when on sick report. He shall devote his time and attention to the service of the Department and shall not engage in any other business or calling to the extent that such business or calling interferes with his efficiency, fitness for duty or the purposes and well-being of the Department as determined by the Chief of Police.
Members of the Department not reporting for duty or absent from assigned duty without proper authorization, will be subject to suspension.
A member of the Department shall be respectful in his contact with others, and shall give his name and shield number to any person who requests it.
A member of the Department shall treat as confidential the official business of the Department except:
A. 
As directed by or with the permission of his superior.
B. 
Under due process of law.
Any operation orders, outlines of operating and administrative procedure, working schedules and other directives of the Chief of Police shall have the same force and effect as these rules and regulations.
Any member of the Police Department may be dismissed from office, in addition to any other punishment he may be subject to by law, when any of the following charges shall be substantiated against him:
A. 
Intoxication.
B. 
Willful disobedience of orders.
C. 
Use of violent, coarse or insolent language or behavior to a superior or other person.
D. 
Receiving money or other valuable things contrary to the rules and regulations.
E. 
Willful noncompliance with rules and regulations.
F. 
Inefficiency or gross neglect of duty.
G. 
Willfully maltreating or using unnecessary violence towards a prisoner or citizen.
A. 
Police headquarters will be used exclusively for police business.
(1) 
No person shall be permitted to remain in an office or hallway without the express permission from the officer in charge, except members of the Department and persons on official business.
(2) 
The offices of the police headquarters will be occupied and used only by members of the Police Department for police purposes and not for the transaction of any business other than that pertaining to the Police Department.
(3) 
Civility and attention will be shown to every person applying at the police headquarters on business.
B. 
All offices and areas of the police headquarters will be kept clean and in order at all times.
C. 
The officers on duty in the station house must at no time sit upon any desk or cabinet, nor at any time when sitting in the chairs put their feet on the cabinets or desks.
A member of the Department shall maintain in a clean and serviceable condition such articles of uniform and equipment as are prescribed for his rank or position and duty to which he is assigned.
A. 
Caps will be worn squarely upon the head at all times.
B. 
Caps will be worn at all times while on foot or motor patrol except when entering homes, offices or other areas where courtesy and standards of gentlemanly conduct require removal of the cap.
C. 
Black shoes, either low-cut type or high-cut type suitable for police duty and approved by the Chief of Police will be worn at all times with the uniform.
D. 
Shoes, belts, holsters and other leather goods will be kept polished at all times.
E. 
When low-cut shoes are worn, black socks will be worn with the uniform.
F. 
Members of the Police Department shall not be out of uniform at any time while on duty. Sweaters and insulated clothing shall be worn only underneath uniform equipment so as not to be visible.
G. 
Distinguishable police uniform will not be worn on the street in conjunction with civilian clothing.
The Chief of Police will arrange and schedule vacation time for Police Department personnel consistent with the following policy:
A. 
Personnel with less than five years of service will be eligible for vacation time of 12 working days per calendar year.
B. 
Personnel with more than five years of service will be eligible for vacation time of 18 working days per calendar year.
C. 
An employee may be credited with unused vacation time but at no time will the total of accrued and current vacation time exceed 24 working days in a calendar year.
D. 
Vacation time for newly appointed or resigning personnel will be computed on a proportional basis to the nearest full month of service during the calendar year.
Working schedule indicating duty days and days off will be posted by the Chief of Police. Deviation from posted schedule must have approval of the Chief of Police.

The following rules and regulations shall apply to the members of the police force and such members of the police force, as a condition of their employment, shall act in conformity with the following rules and regulations:
A. 
No policeman is to transport, in the course of his employment, any prisoner outside the corporate limits of the Village of Canton without the prior express permission of his superior officer.
B. 
No policeman shall, in the course of his employment, deliver a material witness pursuant to the Criminal Procedure Law without first having obtained the permission of his superior officer.
C. 
No policeman shall, in the course of his employment, serve a subpoena or court order or other lawful process upon a witness or party to a court action or proceeding outside the Village of Canton without first having obtained the consent and permission of his superior officer.
D. 
No policeman shall, while in the course of his employment, follow in hot pursuit a person who has committed a crime or offense or who has violated a local law or ordinance unless such crime, offense or violation has occurred within the limits of the Village of Canton.
E. 
No policeman shall effectuate, in the course of his employment, an arrest pursuant to a warrant outside the corporate limits of the Village of Canton without first having obtained the consent or permission of his superior officer.
F. 
No policeman shall, in the course of his employment, exercise any authority as a police officer of said Village of Canton beyond the boundaries of such village except as hereinabove authorized unless specific authority is granted to such policeman by his superior officer.
These rules and regulations shall not prohibit a uniformed policeman of the Village of Canton from:
A. 
Exercising authority as a policeman of the Village of Canton while a felony is committed or attempted in his presence.
B. 
From arresting a person who has committed a felony, although not in his presence.
C. 
Exercising authority as a policeman of the Village of Canton when so requested by:
(1) 
Director of Civil Defense, St. Lawrence County.
(2) 
Sheriff's Department, St. Lawrence County.
(3) 
Mutual Aid, St. Lawrence County.
(4) 
New York State Police, Canton substation.
