It shall be unlawful for any minor under the age of 16 years to be or remain in or upon any of the streets, alleys or public places in the Village of Carthage after the hour of 10:00 p.m., unless such person is accompanied by a parent, guardian or other person having the legal custody of such minor person or unless such minor shall show to any officer who shall demand it a statement, in writing, dated upon that day, signed by such parent or guardian or other adult custodian, that such minor is on a lawful errand for such parent or guardian or unless the business or employment of such minor, engaged in with the consent of the parent or guardian or other custodian of such minor, makes it necessary to be on the streets or other public places in said Village after the hours specified herein; provided, however, that this exception shall not apply when such minor shall be playing or unnecessarily loitering in or upon any street or public place in said Village.
It shall be unlawful for any parent, guardian or other person having the legal care and custody of any minor under 16 years of age to allow or permit any such child, ward or other person under such age while in such legal custody to go or be in or upon any of the streets, alleys or public places in the Village of Carthage after the time specified in § 63-1 of this article unless a reasonable necessity exists therefor.

Any such minor, actually or apparently under the age of 16 years, who shall be found on any street or other public place within said Village, except as hereinbefore provided, shall be taken home by any peace officer of the Village, who shall then and there investigate the facts and circumstances and make a report thereof in writing. Any parent, guardian or other custodian of such minor who shall permit such minor to be upon the streets or other public places of the Village after the hours set forth above, contrary to the provisions of this article, shall be punishable in accordance with Chapter 5 of this Code.
The police of the Village of Carthage are hereby authorized to apprehend without a warrant any person willfully violating the provisions of § 63-1 of this article and detain such person for a reasonable time in which the complaint can be made and a warrant issued and served and the parents or guardian of such child notified of such detention.
A warning signal shall be given at 9:45 p.m. each evening and the curfew signal at 10:00 p.m. and shall be the customary signal for alarm purposes as determined and announced by the Trustees of said Village.

It shall be unlawful for any person to be on or remain in or upon Park Drive or any of the lands or areas comprising the municipal park, athletic field or recreation area from 10:00 p.m. until 6:00 a.m., unless such person is there pursuant to a special permit issued by the Chief of Police of the Village of Carthage.

Any person who shall be found on Park Drive, the municipal park, athletic field or recreation area after the hour of 10:00 p.m. shall be punishable in accordance with the provisions of Chapter 5 of this Code.
The Chief of Police of the Village of Carthage is hereby authorized to issue special permits for the conduct of activities extending past the hour of 10:00 p.m.
The police of the Village of Carthage are hereby authorized to apprehend without a warrant any person violating the provisions of § 63-6 of this article and detain such person for a reasonable time in which the complaint can be made and a warrant issued.
