Unless otherwise authorized by the Village Board of Trustees, it shall be unlawful and an offense against this chapter for any person to drink or otherwise consume liquor, wine, beer or other alcoholic beverages or to have in his or her possession or to carry or transport any open bottle or open container containing liquor, wine, beer or other alcoholic beverages on any public sidewalk, street, highway, parking lot, public park or other place within the Village of Cedarhurst. An open bottle or open container in any vehicle, while in or on any public sidewalk, street, highway, parking lot, public park or other public place, shall be presumptive evidence that the same is in possession of all occupants thereof and is an offense against this section.

The label, tag or marking on the container containing the beverage or liquid reflecting that it contains any quantity of alcohol shall be presumptive proof of the alcoholic content of said beverage or liquid.

The provisions of § 68-1 shall not apply in the event of a fair, picnic or other community gathering for which special permission has been granted by the Board of Trustees subject to such rules and regulations as may be established by the Board of Trustees pursuant to the granting of said permission.[1]

Any person violating any provision of this chapter shall be liable to a penalty set in accordance with Chapter 1, Article III, General Penalty.
