The Board of Trustees hereby finds and determines that the public health, safety and general welfare dictate and require that the village enact provisions for the registration of residential properties within the village which are not owner-occupied. Unregulated rental activity by absentee owners tends to foster neglect and disrepair of properties and presents dangers to the inhabitants and/or to other residents of the village and results in a reduction in the quality of maintenance of such properties, as well as a negative impact upon the health, safety and welfare of the public and property values. The Board further finds that in times of emergency, it is important to have the necessary information on file with the village as to contact persons authorized on behalf of such absentee owners to deal with any such emergency condition, as well as owners and occupants.
The owners of all properties, wherein such owner shall not actually reside shall be required to register in accordance with this chapter, with the Clerk-Treasurer of the village.
A registration form shall be supplied by the Village Clerk-Treasurer which shall contain the names, addresses and both a daytime and evening telephone number for each owner, as well as the names, and both daytime and evening telephone number for each occupant and managing agent. A new registration shall be filed by the owner with each change of occupancy, whether such occupancy shall be by written lease, oral lease or month-to-month basis.
The owner, any managing agent and each tenant or occupant shall be liable for any violation of this chapter and/or failure to register.
Any violation of this chapter and/or failure to register shall be punishable by a fine set in accordance with Chapter 1, Article III, General Penalty. Each day in which there shall be a failure to so register shall be deemed a separate violation.
