No certificate for the occupancy of any dwelling or other structure shall be issued unless all curb and sidewalk specifications shall have been complied with and the approval of the Building Official obtained thereon. Curb cuts shall comply with the provisions of § 224-9.

A. 
Application for permit; fee.

(1) 
It shall be the duty of any person constructing any curb or sidewalk to make written application therefore to the Village Clerk-Treasurer. Such application shall designate the street, avenue, highway or public place upon which said curb or sidewalk is to be constructed, any such applicant shall pay such fee as set by the Board of Trustees by resolution of a majority vote of its members present at a Board meeting.[1]

(2) 
It shall be the duty of any person repairing any curb or sidewalk to make written application therefore to the Village Clerk-Treasurer. Such application shall designate the street, avenue, highway or public place upon which said curb or sidewalk is to be repaired and such applicant shall pay such fee as set by the Board of Trustees by resolution of a majority vote if its members present at a Board meeting.
B. 
Grade. No person shall construct or cause or permit to be constructed a curb or sidewalk of cement, concrete, stone, brick or other similar substance on any street, highway or other public place within the Village without first obtaining from the Superintendent of the Building Department of said Village the proper grade for such curb or sidewalk upon such street, avenue, highway or public place upon which said curb or sidewalk is to be constructed and or repaired.

Any person violating any provision of this article shall be liable to a penalty set in accordance with Chapter 1, Article III, General Penalty.
