This chapter shall be administered and enforced by the Code Enforcement Officer of the Town of Sweden, and no permit shall be issued unless the provisions of this chapter are complied with.
Fraud or substantial mistake in any application or map shall constitute a violation of this chapter and be sufficient for revocation of any permit granted, in addition to any other statutory penalty.
A. 
Any person, firm, corporation or entity found to be violating any provisions of this chapter shall be served with a written notice stating the nature of the violation and providing the immediate correction thereof.

B. 
A violation of this chapter is hereby declared to be an offense, punishable by a fine not exceeding $350 or imprisonment for a period not to exceed six months, or both for conviction of a first offense; for conviction of a second offense both of which were committed within a period of five years, punishable by a fine not less than $350 nor more than $700 or imprisonment for a period not to exceed six months, or both; and, upon conviction for a third or subsequent offense all of which were committed within a period of five years, punishable by a fine not less than $700 nor more than $1,000 or imprisonment for a period not to exceed six months, or both. However, for the purpose of conferring jurisdiction upon courts and judicial officers generally, violations of this chapter shall be deemed misdemeanors and for such purpose only all provisions of law relating to misdemeanors shall apply to such violations. Each week's continued violation shall constitute a separate additional violation.

C. 
Any person, firm, corporation or entity violating the provisions of this chapter shall become liable to the Town for any expense or loss or damage occasioned the Town by reason of such violation.
D. 
In the alternative, the Town may maintain an action or proceeding in a court of competent jurisdiction to restrain by injunction any violation of this chapter.
E. 
The penalties and remedies set forth herein are in addition to all other penalties and remedies provided for by law.
