A. 
The title of this article shall be "Appointment of Vice Chairperson and Second Vice Chairperson to the Planning Board of the Town of Clarence."
B. 
This article shall apply to the appointment, terms, functions and powers of Vice Chairperson and Second Vice Chairperson appointed to serve on the Town of Clarence Planning Board.
The Chairperson of the Planning Board may have to recuse him or herself from participating in a specific matter before the Planning Board because of a conflict of interest or may be absent because of illness, vacation or other reasons. The Vice Chairperson and Second Vice Chairperson are hereby authorized to act as the Chairperson under those circumstances.
A. 
The Town Board of the Town of Clarence hereby adopts this article to provide a process to appoint a member of the Planning Board as Vice Chairperson and Second Vice Chairperson.
B. 
A Vice Chairperson and Second Vice Chairperson of the Planning Board shall be appointed by the Town Board of the Town of Clarence at its organizational meeting each year.
C. 
The appointment will be for a period of one year.
D. 
The Vice Chairperson shall serve in the absence of the Chairperson. The Second Vice Chairperson will serve as the acting Chairperson in the absence of the Chairperson and the Vice Chairperson.
E. 
All provisions of state law relating to Planning Board members' eligibility, vacancy in office, removal, compatibility of office and service on other boards, as well as any provision of a local law or local ordinance relating to training, continuing education, compensation and attendance, shall also apply to the Vice Chairperson and Second Vice Chairperson.
This article is adopted pursuant to the provisions of the Municipal Home Rule Law § 10.
It is the intent of the Town Board of the Town of Clarence, pursuant to § 10 of the Municipal Home Rule Law, to supersede the provisions of § 271 of the Town Law relating to the appointment of members of the Planning Board.
