The Chairperson of the Zoning Board of Appeals may have to recuse him
or herself from participating in a specific matter before the Zoning Board
of Appeals because of a conflict of interest or may be absent because of illness,
vacation or other reasons. The Vice Chairperson is hereby authorized to act
as the Chairperson under those circumstances.
A.
The Town Board of the Town of Clarence hereby adopts
this article to provide a process to appoint a member of the Zoning Board
of Appeals as Vice Chairperson.
B.
A Vice Chairperson of the Zoning Board of Appeals shall
be appointed by the Town Board of the Town of Clarence at its organizational
meeting each year.
C.
The appointment will be for a period of one year.
D.
The Vice Chairperson will serve as the acting Chairperson
in the absence of the Chairperson.
E.
All provisions of state law relating to Zoning Board
of Appeals members' eligibility, vacancy in office, removal, compatibility
of office and service on other boards, as well as any provision of a local
law or local ordinance relating to training, continuing education, compensation
and attendance, shall also apply to the Vice Chairperson.
This article is adopted pursuant to the provisions of the Municipal
Home Rule Law § 10.
It is the intent of the Town Board of the Town of Clarence pursuant
to § 10 of the Municipal Home Rule Law to supersede the provisions
of § 267 of the Town Law relating to the appointment of members
of the Zoning Board of Appeals.
