It shall be unlawful for any person, firm or corporation to install or leave hanging or attached by any means any bag, holder or receptacle of any kind containing advertising material or samples or to distribute advertising material or samples in the Town of Clarence by placing the same at any residence or on any property in the Town unless such person, firm or corporation leaving or distributing the same shall have obtained the prior written consent of the owner or occupant of such residence or property.
The foregoing prohibitions shall not apply to the distribution of any advertising material or samples through or by the United States Postal Service, nor shall the foregoing prohibitions apply to the distribution of any subscription newspaper or publication of the second class as defined by the Postal Service nor the advertising materials or samples of any charitable or nonprofit organization.

A violation of this chapter shall be deemed an offense, and any person, firm or corporation convicted of such violation shall be subject to a fine of not more than $250 or imprisonment for not more than 15 days, or both, for each violation, or such violation may be enjoined by appropriate application to the Supreme Court.
