All operations shall be conducted only between 6:00 a.m.
and 6:00 p.m., local time, unless extended operation is approved by the Town
Board. No operations shall be conducted on Sunday.
No excavation shall be made that will lessen the slope
of all sides being left from top to bottom of one and one-half (1Â 1/2)
feet horizontal distance for each one (1) foot of vertical drop. The Town
Board may permit a licensee, in lieu of the aforesaid grading, to construct
a permanent fence or barricade on all sides of the excavation or excavations
or along a part thereof for the protection of the public during the operation
and after the completion thereof.
An accurate record shall be kept of cubic yards removed,
and it shall be certified quarterly to the Town Clerk. If the Town Board has
cause to believe that accurate records are not kept or so certified, said
Board may retain professional services to determine the same and charge the
reasonable cost thereof to the licensee.
Blasting shall be under the supervision of a duly licensed person or persons and shall be done only during the operating hours as set forth under Subsection A above. Explosives shall be handled and stored as required by state law.
The Town Clerk shall charge and collect for each permit
with the Town Board's approval a minimum fee of two hundred dollars ($200.)
for an excavation volume not to exceed twenty thousand (20,000) cubic yards.
For excavations exceeding twenty thousand (20,000) cubic yards, the minimum
fee shall be two hundred dollars ($200.) plus one cent ($0.01) for each additional
cubic yard or fraction thereof.
In lieu of the foregoing fees and accurate cubic yard removal records as required under § 93-16E of this article, the applicant, with the Town Board's approval, may pay a fixed fee of two thousand dollars ($2,000.) for unrecorded removal.
A bond or cash deposit shall be posted with the Town as required by § 93-9 of this Part 2, which bond or cash deposit, to be determined by the Town Board, shall be no less than fifteen thousand dollars ($15,000.) for each excavation.
