Editor's Note: This local law also stated that it applied to all new residential permits and commercial/industrial projects not previously given concept approval as of the date of the adoption of this law.
The following fees for recreation and open space purposes are established as follows:
A. 
A flat fee of $450 per new residential lot development shall be assessed upon the building permit fee for any new residential building permit as an open space fee. In subdivisions approved prior to the effective date of this subsection, a flat fee of $250 shall apply to all building permits. A flat fee of $250 shall apply to all building permits applied for prior to the effective date of this subsection. Such fees shall be in addition to any recreation fee assessed on residential units per Chapter 193. Subdivision of Land, of the Code of the Town of Clarence and § 277 of the Town Law.
B. 
A flat fee of $450 per new residential multiple-family housing unit shall be assessed upon the building permit fee for any new multiple-family residential project for which a special exception use permit has been issued by the Town Board, such fee to be identified as the recreation fee for such projects.
C. 
A fee of $0.15 per gross square foot of commercial and industrial construction (not including multiple-family residential under a special exception use permit) shall be assessed upon the building permit fee for any new commercial/industrial building permit. No recreation assessment would be charged for such uses since these developments generate no demand for recreational facilities.
D. 
Open space fees shall be paid to an office of repository authorized to collect such fees by the Town Board from time to time. The office of repository to receive open space fees will be posted in the office of the Town Clerk.
E. 
The open space fees shall be deposited in a capital reserve fund established by the Town Board in a separate bank account known as the "Special Revenue Fund" to be used for future acquisition of open space at the discretion of the Town Board.
F. 
Recreation fees shall be paid to an office of repository authorized to collect such fees by the Town Board from time to time. The office of repository to receive open space fees will be posted in the office of the Town Clerk.
G. 
The recreation fees shall be deposited is a fund established by the Town Board and to be utilized for recreational purposes at the discretion of the Town Board.
