GENERAL REFERENCES

This chapter shall be known as the "Retail Twenty-Pound Propane Tank
Standards of the Town of Clarence."
The purpose of this chapter is to regulate the storage and handling
of twenty-pound portable propane cylinders held for resale or exchange at
retail consumer sites in order to properly protect life and property in the
Town of Clarence.
A permit must be obtained from the Town of Clarence Building Department
prior to installation of a storage facility.
A.
Storage of twenty-pound portable propane cylinders by
retail outlets shall be made in conformance with the requirements of the New
York State Fire Prevention and Building Code, current edition; and NEPA -
58 Chapter 5, except where the provisions of this chapter or other local law
or ordinance shall differently prescribe; in which event, compliance with
these provisions of such local law or ordinance shall be considered compliance
with this chapter.
B.
Retailers holding portable twenty-pound propane cylinders
for resale or exchange are required to install an outdoor storage facility
for all full and empty cylinders and must adhere to all standards set forth.
A.
To protect propane gas cylinders from vehicular damage,
the retailer is required to install four-inch steel guard posts (concrete
filled) four (4) feet above and four (4) feet below grade, placed four (4)
feet on center with a guard rail to all sides that are exposed to vehicular
traffic.
B.
The twenty-pound propane gas cylinder storage facility
(hereforth referred to as "cage") must be made of metal with a solid top and
solid sides extending three (3) inches down from the top, at least one-eighth-inch
thickness painted white to avoid excessive heat buildup from sunlight. The
frame is to be at least a one-fourth-inch by two-inch angle covered with industrial
heavy duty expanded metal with opening not over one (1) inch, or any other
type of metal approved by the Town Engineer.
C.
The storage cage must be properly vented to avoid gas
buildup.
D.
The storage cage shall be constructed a minimum of ten
(10) feet from any combustible building, outbuilding or gas pumps.
E.
The storage cage shall be constructed above the grade
of the land.
F.
The storage cage shall be located on a concrete surface
free of grass and shrubs.
H.
Each retail location shall be equipped with at least
one (1) approved portable fire extinguisher having a minimum capacity of twenty
(20) pounds dry chemical with B:C rating. The extinguisher shall be displayed
in an easily accessible manner located no farther than twenty-five (25) feet
and no closer than six (6) feet from the storage cage.
I.
No storage cage shall have the storage capacity of more
than fifty (50) twenty-pound propane cylinders whether full or empty. No retail
outlet shall contain more than one (1) storage cage.
J.
There will be no cylinders, full or empty, stored or
temporarily located anywhere on the premises except inside a locked storage
cage.
K.
The roof of the cage shall be unobstructed at all times.
Cylinders, signs and other objects may not be placed on the cage roof.
L.
The storage cage shall not be placed above an underground
gasoline storage tank and must be located at least twenty-five (25) feet from
an in-ground gas storage tank vent and/or an aboveground gas storage tank.
M.
There will be no on-site cylinder filling authorized
with this permit.
N.
All cylinders received by the retail outlet for resale
will be either new or reconditioned, including painted white, and requalified
to all New York State and federal regulations.
O.
All propane gas contained within cylinders brought to
a retail site shall be odorized.
P.
The completed storage cage and installation thereof shall
be inspected by Town of Clarence Building Department and a certificate of
compliance issued prior to use, and is subject to a yearly inspection.
