No road or highway crossing shall be constructed on or across the Peanut Line without a road-crossing permit issued by the Clarence Town Board.
A. 
There shall be a fee of two hundred fifty dollars ($250.) per dwelling for a road-crossing permit granted to an open development, and it shall be paid at the time each building permit is granted.
B. 
There shall be a fee of ten thousand dollars ($10,000.) for all other developments requiring a permit, and it shall be paid at the time the development plan is approved.
C. 
The Planning Board may also recommend a crossing fee when direct benefit from such crossing is derived by a contiguous or nearby developer.
