No person shall install, erect, hang, lay, bury, draw, emplace, construct, repair, or reconstruct any right-of-way facility upon, across, beneath, or over any public right-of-way and/or bikepath in the Town without first contacting the Town Highway Department and obtaining a work permit, therefor, from the Town Highway Department if required.
The Highway Superintendent or designee shall issue all work permits and inspect the work under each; and determine permit fees with Town Board approval. Work permit applications may be obtained from the Highway Department office.
Any person who shall violate this article shall be guilty of an offense and, upon conviction, shall be subject to a fine of not less that $100 and not more than $250 for each and every offense. Each week of violation shall constitute a separate and additional violation. Notwithstanding the penalty herein above provided, the Town of Clarence may enforce compliance with this article or any part thereof by injunction to restrain said violations.
