The Town Board finds that it is in the interest of the public health and safety to permit the use of Town Highway Department equipment and employees on private property during certain emergency situations.
A. 
The Town Highway Superintendent is hereby authorized to use the equipment and the employees of the Town Highway Department to assist the Fire Department, Police Department, rescue squad, and other similar emergency service agencies in dealing with emergency conditions or situations.
B. 
The Town Highway Superintendent is authorized during emergency situations to enter upon private property, with Highway Department equipment and employees, to cut and remove trees, cut fire lanes, plow and sand private roadways, and provide any other similar service which the Town Highway Superintendent determines necessary to assist any emergency service agency in dealing with a specific emergency condition or situation.
