The hawking and peddling of goods, wares, merchandise or produce in
the public or private highways, public or private streets or public places
or the vending of the same by calls from house to house without a license
permitting the same shall be prohibited in the Town of Dover, County of Dutchess
and State of New York.

As used in this chapter, the following terms shall have the meanings
indicated:
Includes, except as hereinafter expressly provided, any person, either
principal or agent, who from any public place of business to place of business,
on foot or on or from any vehicle, sells or barters, offers for sale or barter,
or carries or exposes for sale or barter any goods, wares or merchandise,
books, magazines, periodicals or any other item or items of value, except
milk, newspapers and food distributed on regular customer routes.
Includes any person who parks a motor vehicle on or near a public
street in connection with the operation of selling merchandise and/or refreshments.

The annual license fee, the semiannual fee and the quarterly fee shall be as provided in Chapter 73, Fees, all payable upon the issuance of the license.
Each and every hawker or peddler shall have a license.

A.
Any person desiring a license, as herein provided, shall
file with the Code Enforcement Officer a written application therefor, duly
certified by the applicant upon blank forms provided by the Code Enforcement
Officer. A license may be taken out only by an individual and not in the name
of a firm, corporation, association, club or other group. Such application
shall include, but not be limited to, the following information:
(1)
The name, address, date of birth, social security number
and motorist identification number of said person and the name of such corporation,
firm, association, club, partnership or other organization involved.
(2)
A description of the type of goods, wares and/or merchandise
that the applicant wishes to sell or solicit orders for.
(3)
A description of the vehicle that the applicant wishes
to use in carrying out his/her business or occupation.
(4)
The owner of the vehicle and registration details thereof.
(5)
The County Health Department permit number, if a food
vendor.
(6)
The manner and method of operation, including the location
of the activity and proposed hours of operation.
B.
The Code Enforcement Officer shall not issue any licenses
pursuant to this chapter if the activity as described by the applicant has
a likely effect of interfering with vehicular traffic or creating any undue
traffic hazard or which will disturb the tranquility of residential neighborhoods.

Nothing in this chapter shall be deemed to apply to any of the following:
A.
Any person selling produce as permitted by the New York
State Agriculture and Markets Law.
B.
Any person soliciting or collecting for any bona fide
charitable or religious organization.
C.
Any person who holds a license issued pursuant to § 32
of the General Business Law pertaining to veterans of the Armed Forces of
the United States.
