The Town Planning Board of the Town of Ghent
shall have the following rights, powers and privileges in connection
with any application before the Board.
The Town of Ghent Planning Board shall have
the power and authority to carry out all rights and duties as provided
in the Town of Ghent Zoning Ordinance.
In addition to any fees required from an applicant
appearing before the Town of Ghent Planning Board in connection with
any application, whether for subdivision approval, site plan approval
or otherwise, the applicant shall also be required to pay all expenses
incurred by the Planning Board in connection with processing and reviewing
such application, including fees for mailing and advertising expenses,
and including any fees and expenses incurred by the Planning Board
for the retention of any experts.

In connection with any application before the
Town of Ghent Planning Board, the Planning Board is hereby authorized
and empowered to retain any expert who the Planning Board, in its
sole discretion, deems necessary in order to properly review and evaluate
the proposed application, including an engineer, for which the cost
of same shall be borne by the applicant. In this regard, the Planning
Board may require such costs to be paid in advance and may deny an
application upon failure of the applicant to make such payment in
a timely manner. Notwithstanding anything to the contrary contained
herein, only the Town Board shall have authority to appoint, retain,
and remove legal counsel to represent the Town or any of its boards.
