A truck route system for the Town of Ghent is hereby established.
All state highways and County highways passing through the Town of Ghent shall be part of this system. All Town highways passing through the Town of Ghent shall be part of this system except for the following highways which are excluded from this system:
A. 
Soller Heights Road from its intersection with New York State Route 66 to its intersection with Arch Bridge Road.
B. 
Link Road.
C. 
Letter S Road.
D. 
Tallerico Road from County Route 30 south as far as Tallerico/Spook Rock Road.
E. 
Tallerico/Spook Rock Road from County Route 30 south as far as Link Road.
F. 
Stockport Road from the Stockport Town line to New York State Route 9H.
No trucks, tractors, tractor-trailer combinations or other motor vehicles having a total gross weight in excess of 10,000 pounds shall be permitted to travel on any Town highways excluded from the truck route system as specified in § 175-2 herein.
A. 
This article shall not be construed to prevent the delivery or pickup of merchandise or other property along the Town highways excluded from the truck route system.
B. 
This article shall not be construed to prevent the operation of any such overweight vehicle on an excluded Town highway by an operator who resides on such highway for the limited purpose of travel to and from his or her residence.
C. 
This article shall not apply to any fire or other emergency vehicles.

Any person who operates a vehicle with a gross weight of over five or more tons on any Town highway designated herein in violation of this article shall be guilty of a violation and shall be subject to a fine of not more than $350 or to imprisonment for not more than 15 days, or both. Each time a vehicle is operated in violation of this chapter it shall constitute a separate and distinct violation.[1]

A. 
No motor vehicle may be parked on or along a Town highway, within the legal right-of-way of such highway, including the shoulder thereof, during the period November 1 of each year through April 15 of the following year.
B. 
The owner or operator of any motor vehicle that is parked on or along a Town highway, right-of-way or shoulder of such Town highway in violation of this article shall be guilty of a violation and shall be subject to a fine of not less than $50 nor more than $350 for each such violation. For the purposes of this article, each day shall constitute a separate violation.
C. 
The Town Superintendent of Highways shall have the right to remove or cause to be removed by towing any motor vehicle parked on or along a Town highway, right-of-way or shoulder of such highway in violation of this article. The owner of such motor vehicle will be liable for payment to the Town of Ghent of a towing fine in the amount of $150. Such towing fine shall be in addition to the penalty for any violation of this article as set forth in Subsection B above.
