GENERAL REFERENCES
Bicycles — See Ch. 125.
The purpose of this chapter is to provide for the safety, health and general welfare of the residents of the Borough and the users of the streets and sidewalks of the Borough. By this chapter, the Borough seeks to prevent any residents or users of streets and sidewalks from sustaining personal injury or property damage as a result of the use and operation of skateboards, roller skates, in-line skates and scooters within the Borough of Fanwood.
As used in this chapter, the following terms shall have the meanings indicated:
ROLLER SKATES and IN-LINE SKATES
Boots or shoes with one or more rows of wheels attached to the soles.
SCOOTER
A long footboard between end wheels controlled by an upright steering handle attached to the front wheel.
SKATEBOARD
A single platform mounted on wheels.
A. 
No person shall use a skateboard, roller skates, in-line skates or scooter in parking lots owned or leased by the Borough of Fanwood except to traverse the area by traveling on surfaces normally utilized for pedestrian or vehicular travel. No person shall use a skateboard, roller skates, in-line skates or scooter in the Carriage House Park.
B. 
No person shall use a skateboard, roller skates, in-line skates or scooter on any portion of the Borough of Fanwood train station.
C. 
No person shall use a skateboard, roller skates, in-line skates or scooter on the property of any business, office or commercial operation or any church or synagogue without the prior approval of the owner or owners.
D. 
No person shall use a skateboard, roller skates, in-line skates or scooter on public benches, public bleachers, or public park playground equipment or tables.
Every person operating a skateboard, roller skates, in-line skates or scooter upon streets in the Borough shall operate the same in strict observance of all laws applicable to a motor vehicle and the use thereof and in compliance with all rules of the road applicable to the operation of a motor vehicle and in compliance with all traffic laws, except as to those provisions of laws which, by their nature, can have no application.
Whenever any person shall operate a skateboard, roller skates, in-line skates or scooter upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give an audible signal before overtaking and passing such pedestrian.
The operator of a skateboard, roller skates, in-line skates or scooter, emerging from an alley, driveway or building, shall, upon approaching a sidewalk, yield the right-of-way to all pedestrians approaching on said sidewalk.
No person shall stand, park or otherwise place in a position of temporary storage a skateboard or scooter upon a highway, street, sidewalk or against any building abutting a sidewalk in such a manner that shall obstruct or render injury to a pedestrian or interfere with vehicular traffic.
A. 
A person under 14 years of age shall not operate a skateboard, roller skates, in-line skates or scooter, unless that person is wearing a properly fitted and fastened helmet. Persons using roller skates, in-line skates and scooters must wear a bicycle helmet which meets or exceeds the standards of the American National Standards Institute (ANSI Z90.4 bicycle helmet standard) or the Snell Memorial Foundation's 1990 Standard for Protective
Headgear for Use in Bicycling. Persons using a skateboard must wear a helmet that meets or exceeds the ASTM skateboard helmet standard, F-1492.
B. 
No person shall operate a skateboard, roller skates, in-line skates or scooter at night unless he or she is wearing reflective clothing, which shall be visible from a distance of not less than 50 feet from the front, side and rear of the skateboard, roller skates, in-line skates or scooter when directly in front of the lawful beams of a headlight on a motor vehicle.
The parent of the minor child or the guardian of any minor child shall not authorize or knowingly permit any such child to violate any of the provisions of this chapter.
A. 
Any person who violates any of the foregoing provisions of this chapter shall be subject to a fine of $25 for the first offense and $50 for each subsequent offense and/or community service for a period of up to 90 days.
B. 
Any skateboard, roller skates or in-line skates operated in violation of any of the foregoing sections of this chapter may be immediately impounded. The Borough of Fanwood shall store such impounded skateboards, roller skates, in-line skates or scooters in a suitable secure location. No impounded skateboards, roller skates, in-line skates or scooters may be released until all penalties have been paid.
C. 
Any skateboard, roller skates, in-line skates or scooter not redeemed within 90 days shall become the property of the Borough of Fanwood.

A. 
Skate park rules. Notwithstanding any of the foregoing provisions to the contrary, the following provisions of this Subsection 247-11A shall apply to the Fanwood Skate Park in Forest Road Park:
(1) 
This facility is a "skate at your own risk" skate park.
(2) 
The hours of operation are from 9:00 a.m. to dusk. Trespassing when the park is closed is strictly prohibited.
(3) 
All users must wear helmets. Kneepads, elbow pads, and wrist guards must be worn by users ages 10 and under and are recommended for users ages 11 and older.
(4) 
All users must wear appropriate footwear.
(5) 
All users must skate so as to avoid collision; skating against traffic is prohibited.
(6) 
All users must skate within their ability; reckless skaters will be asked to leave.
(7) 
The facility is designed for skateboards, inline skates, scooters and BMX bicycles. No motorized vehicles are allowed.
(8) 
Use of the facility is prohibited during wet, snowy and icy conditions.
(9) 
All users must inspect the surface of the facility before use, and remove any objects that may prevent a smooth, safe ride.
(10) 
Entrance to the facility is on a first-come-first-served basis and is limited to one hour when other users are waiting.
(11) 
No food is permitted inside the facility.
(12) 
No littering, glass bottles, alcohol, drugs, pets or loud music is allowed. Boom boxes are prohibited.
(13) 
Usage of profanity, indecent, obscene or abusive language or behavior is strictly prohibited.
(14) 
Smoking inside the facility is prohibited.
(15) 
Users ages seven to 10 shall be accompanied by an adult of a minimum age of 18 years old. No users under the age of seven are allowed.
(16) 
Personal ramps, rails, boxes, and other apparatus and modifications to the skate surface are prohibited.
(17) 
No competitive or demonstrative events or amplified music is allowed without prior approval from the Recreation Commission of the Borough of Fanwood.
B. 
No Borough liability. All use of the skate park is at the user's own risk. Fanwood Borough shall have no liability or responsibility for any loss, death, damage or any other injury sustained by any user of the skate park or for loss of any user's personal property.
C. 
Promulgation and posting of skate park rules. In addition to the foregoing skate park rules, the Recreation Commission of the Borough of Fanwood may promulgate and post such other rules, regulations and procedures, which are not inconsistent with this chapter, as it deems just and proper for the safe and efficient operation of the skate park. A copy of the skate park rules shall be available at the office of the Borough Clerk.
D. 
Penalties relating to the skate park. Any person who violates any rule of the skate park as set forth herein or as otherwise promulgated and posted at the facility shall be subject to a fine of $25 for the first offense and $50 for each subsequent offense and may be subject to expulsion from the skate park for a period of up to one year and/or community service for a period of up to 90 days.
