By adoption of this chapter the Town Board of the Town of Deerpark, Orange County, New York declares its intent to provide for the removal of any vehicles parked or abandoned on any highway within the Town during a snow storm, flood, fire or other public emergency which affects that portion of the public highway occupied by said parked or abandoned vehicle and thereby affecting the general public interest within the intent of ยงย 1204 of the Vehicle and Traffic Law of the State of New York and ยงย 64 and ยงย 130 of the Town Law of the State of New York and the police power granted to said Town under the laws and statutes of the State of New York.
As used in this chapter, the following terms shall have the meanings indicated:
OWNER
Owner or person in charge of the vehicle.
PUBLIC HIGHWAY
Any of the public rights-of-way under the care of, maintenance and control of a public municipality whether it be the Town, county or state.
VEHICLE
Any means of conveyance over land on wheels or runners, including a car, truck, motorcycle, carriage, tractor or trailer.
A.ย 
When any vehicle is parked or abandoned on any public highway within this Town during a snow storm, flood, fire or other public emergency which affects that portion of the public highway upon which said vehicle is parked or abandoned, said vehicle may be removed by the Town of Deerpark, Orange County, New York or its designated agents and/or employees.
B.ย 
When any vehicle is found unattended on any highway within this Town where said vehicle constitutes an obstruction to traffic, such vehicle may be removed by the Town of Deerpark, Orange County, New York or its designated agents and/or employees.
C.ย 
When any vehicle is parked or abandoned on any public highway within this Town where stopping, standing or parking is prohibited, said vehicle may be removed by the Town of Deerpark, Orange County, New York or by its designated agents and/or employees.
A.ย 
After removal of any vehicle as provided in this chapter, the Town of Deerpark may store such vehicle in a suitable place at the expense of the owner or person in charge of said vehicle.
B.ย 
Such owner or person in charge of the vehicle may redeem the same upon payment to the Town of Deerpark of the amount of all expenses actually and necessarily incurred in effecting the said removal together with any charges for storage, such storage charges not to exceed $5 per day or fraction thereof. It will be the duty of the Town official, agent or employee who removes such vehicle or orders the same removed to a suitable place, to file with the Town Clerk the amount of all expenses actually and necessarily incurred in effecting the said removal.
The Town official, agent or employee who removes or attends to the removal of such vehicle to a suitable place for storage shall without delay report the removal and the disposition of such vehicle removed to the Town Clerk in writing and it shall be the duty of said Town Clerk to ascertain to the extent possible the owner of the vehicle or person having charge of the same and to notify him of the removal and disposition of such vehicle and of the amount which will be required to redeem the same.
It shall be the duty of the Town Clerk to keep records of all notices of removal plus charges and to gather monies collected from the owner or person having charge of said vehicle removed and to remit the same to the Supervisor of said Town.
