A.
The establishment, preservation, maintenance and development
of bridle paths in the Village of Old Westbury is in the public interest of
the residents of the Village.
B.
Proper development and use of such bridle paths requires
periodic maintenance and continuing supervision.
C.
The Village desires to encourage the establishment, development
and use of bridle paths in the Village with the least possible public expense.
A.
The Board of Trustees and the Planning Board are hereby
authorized to encourage property owners in the Village to dedicate bridle
path easements to the Village for use in accordance with this chapter.
B.
The Planning Board is hereby authorized to require any
applicant for partitioning or subdivision to dedicate to the Village appropriate
bridle path easements as a condition for final approval of his map. The area
of land so dedicated for bridle path easements shall be offset against the
amount of land required under the Village Subdivision Regulations[1] to be dedicated for park purposes.
C.
The Board of Trustees may accept offers of dedication
of bridle path easements upon recommendation of the Planning Board.
A.
The Board of Trustees may, by regulation, provide for
the establishment, safe maintenance, use and policing of bridle paths within
the easement areas, upon such terms and conditions as may be appropriate;
provided, however, that all bridle paths established pursuant to this chapter
shall be available to all residents of the Village on equal terms, and no
bridle path or bridle path easement area shall be used by any motorized vehicles
or equipment other than those required in establishing and maintaining the
bridle paths and those expressly authorized in writing by the Village Board
of Trustees or the Police Department of the Village of Old Westbury.
B.
In lieu of or in addition to the regulations referred
to in this section, the Board of Trustees may enter into an agreement with
any nonprofit organization interested in promoting horseback riding in the
Village for the purpose of providing for the establishment, safe maintenance,
use and policing of bridle paths.
The Planning Board is hereby authorized to develop and prepare a plan
of present and proposed bridle paths in such areas of the Village as the Planning
Board deems suitable.
Any violation of the provisions of this chapter or of any regulation
hereunder which after a public hearing has been approved by the Board of Trustees
shall constitute a violation and shall be punishable by a fine not to exceed
$250.
