These regulations shall be deemed the minimum
requirements for the future growth and development of the Village
which will provide adequate facilities for the housing, transportation,
distribution, comfort, convenience, safety, health and welfare of
its population.
Where the Board finds that, because of special
circumstances of a particular plat, extraordinary hardships, not of
the owner's or subdivider's making, may result from strict compliance
with these regulations, it may vary or waive any of the regulations
so that substantial justice may be done and the public interest secured,
provided that such variation or waiver shall not have the effect of
nullifying the intent or purpose of the Zoning Ordinance,[1] of the Official Map, of the Master Plan, if any, or of
this chapter.
In granting any variance or waiver, the Board
shall set forth in its resolution of approval such conditions as will
substantially secure the objectives of the Zoning Ordinance,[1] the Official Map, the Master Plan, if any, and of this
chapter.
Any person, firm or corporation who or which
shall violate any of these regulations shall be subject to prosecution
and to penalties in the same manner and to the same extent as if such
violation were a violation of the Building Zone Ordinance[1] of the Incorporated Village of Old Westbury.
A.
Each applicant to the Planning Board for the approval of a subdivision or a partitioning shall be liable for and shall pay the fees and costs in the amounts set forth in Chapter 103, Fees and Deposits.

B.
No consideration shall be given by the Planning Board
to any application for preliminary or final approval of a proposed
subdivision or partitioning, nor shall any approved plat be signed,
unless all required fees and deposits shall have been paid.
