A.
Appointment. Pursuant to § 3-1 of the Oneonta
City Charter, the Mayor shall appoint seven members to the City of Oneonta
Planning Commission, hereinafter referred to as the "Commission." All appointments
shall be subject to confirmation by the Common Council. The Mayor shall also
appoint an alderman as liaison member, who shall be an ex officio member of
this Commission, and who shall also serve at the pleasure of the Mayor.
B.
All Commissioners shall be appointed to terms of office
of three years. Terms of office shall be staggered so as to allow for expiration
of terms each consecutive year. In the event that the full membership, or
a majority thereof, must be newly appointed, three of the seven members shall
be appointed for a period of one year, two for a period of two years and two
for a period of three years. All appointments to fill vacancies shall be for
the unexpired term. All appointees shall serve at the pleasure of the Mayor.
C.
Chairman and staff. The Commission shall elect annually
a Chairman and a Vice Chairman from its own members. The Commission from time
to time may require the services of professional staff and clerks as may be
necessary and proper and shall petition the Common Council to appropriate
funds for said services.
The Commission shall have all the powers set forth in Article 12-A of
the General Municipal Law and Article 3 of the General City Law, and, in addition
or supplementary thereto, the Commission shall have the following powers and
duties:
A.
To prepare and recommend to the Common Council every
three years, beginning from the time of formal adoption by the Common Council,
such changes in the Comprehensive Plan or any part thereof as may be deemed
necessary by the Common Council or by the Commission.
B.
Based upon the duly adopted Comprehensive Plan for the
City of Oneonta, prepare and recommend to the Common Council a plan of public
improvements, looking to the present and future development and growth of
the city. Such a plan after its adoption by the Common Council will be known
as the "official plan." Such plan shall include reasonable requirements in
reference to streets, alleys and public grounds within the corporate limits
of the city and of lands owned by the city wherever located.
C.
To give aid to the city officials charged with the direction
of projects for improvements, embraced within the Comprehensive Plan, and
generally to promote the realization of the official Comprehensive Plan.
D.
To arrange and conduct any form of publicity relative
to its activities for the general purpose of public understanding.
E.
To cooperate with municipal and regional planning commissions
and other agencies or groups to further the local planning program and to
assure harmonious and integrated planning for the area.
F.
To exercise such other powers germane to the powers granted
by statute.
On all matters referred to the Commission, a decision thereon must be
made within 30 days in writing to the official or body referring the same,
otherwise approval of the project is deemed to have been made by the Commission
pursuant to § 29 of the General City Law.
This Commission shall meet at least once a month whenever there shall
be any lawful business to transact.
Following the adoption of an official Comprehensive Plan in the manner
prescribed by this chapter, no map or plat of any subdivision affecting land
within the corporate limits of the city shall be entitled to be recorded or
be valid, unless approval thereof by this Commission has been granted, in
writing, pursuant to the provisions of the regulations of the Code of the
City of Oneonta.
The City Clerk and the City Engineer shall furnish to the Commission
for its consideration a copy of all ordinances, plans and data relative to
public improvements of any nature. The Commission may report in relation thereto
if it deems a report necessary or advisable for the consideration of the Common
Council.
