Unless otherwise expressly stated, the following terms shall, for the purposes of this chapter, have the meanings herein indicated:
DISPOSE
To throw, cast, drop, dump, deposit or place.
LITTER
Any and all discarded material, including but not limited to ashes, garbage, papers, empty containers, rubbish, refuse, demolition debris, discarded construction materials and discarded appliances and furniture.
PERSON
Any individual, partnership, corporation or unincorporated association, including the agents, servants and employees thereof.
No person shall dispose or cause to be disposed, litter upon any street, public property, waterway or property of another person. Such prohibition shall include the unauthorized placement of containers or vehicles containing litter upon public property or the property of another person but shall not include disposal of litter in any facility or area authorized for that purpose by the town or the New York State Department of Environmental Conservation.
A. 
Any person found guilty of violating this chapter by disposing or causing to be disposed one pound or less of litter shall be guilty of an offense as set forth in § 135 of the Town Law and, upon conviction thereof, shall be punished by a fine not exceeding $250.
B. 
Any person found guilty of violating this chapter by disposing or causing to be disposed more than one pound but less than 10 pounds of litter shall be guilty of an offense as set forth in § 135 of the Town Law and, upon conviction thereof, shall be punished by a fine not exceeding $1,000 or imprisonment for not more than five days, or both.
C. 
Any person found guilty of violating this chapter by disposing or causing to be disposed 10 pounds or more of litter shall be guilty of an offense as set forth in § 135 of the Town Law and, upon conviction, shall be punished by a fine not exceeding $5,000 or imprisonment for not more than 15 days, or both.
D. 
In addition, any person who disposes or causes to be disposed litter shall be liable to the town for any costs incurred by the town in removing and properly disposing of such litter, whether these costs are incurred directly by the town or through the town's contracting for such removal and disposal.
