By the adoption of this chapter, the Town Board of the Town of Schodack declares its intent to regulate, in a manner consistent with the interests of the citizens of the Town of Schodack, the use of water during the imposition of water use restrictions imposed by the town and/or the Village of Castleton. These restrictions, imposed during periods of water shortage, are a public health necessity. Therefore, recognizing the above and the need for adequate regulation and enforcement of these restrictions and in the exercise of its police powers in this regard, the Town Board of the Town of Schodack does hereby enact this chapter.
The Town Board of the Town of Schodack declares its intent to allow the Town Supervisor to impose total or partial water restrictions on a per-district basis whenever he declares a public emergency or whenever one is declared by the Mayor of the Village of Castleton for residents outside the village serviced by the village of Castleton. When imposed, water use restrictions shall remain in effect until further notice by the town.
A. 
This chapter shall apply whenever water use restrictions are imposed and shall apply to all persons. Such term "persons" shall include all individuals, firms, partnerships, corporations, municipalities or municipal corporations and associations of persons who are serviced by town water districts.
B. 
This chapter shall also apply to town residents who are serviced by the Castleton Water District.
A. 
Total restrictions.
(1) 
Gardens may be watered for a maximum of two hours every other day from 7:00 p.m. to 9:00 p.m. Persons with even-numbered houses may water their gardens on even calendar days; persons with odd-numbered houses may water their gardens on odd calendar days.
(2) 
Any other outdoor use of water is hereby prohibited, including but not limited to the washing of vehicles of any kind and watering of lawns.
B. 
Partial restrictions. All outdoor use of water is prohibited except that outdoor watering for any reason may occur for a maximum of two hours every other day from 7:00 p.m. to 9:00 p.m. Persons with even-numbered houses may water on even calendar days; persons with odd-numbered houses may water on odd calendar days.
A. 
Any person violating any of the provisions of this chapter shall be subject to a fine of:
(1) 
Fifty dollars for the first offense.
(2) 
One hundred dollars for the second offense.
(3) 
Two hundred fifty dollars and/or imprisonment for a period not to exceed 15 days, for each subsequent offense.
B. 
Continued violation after formal notice thereof has been given shall constitute a separate violation. The Town Board shall have the power to bring a civil action to restrain any violation of the chapter in a court of competent jurisdiction.
The enforcement of this chapter shall be performed by any of the following: Town Building Inspector, town police, Town Highway Superintendent or their designees.
