[HISTORY: Adopted by the Council of the City of Watervliet 3-28-1974 as Ord. No. 1175; amended in its entirety 10-15-1981 by Ord. No. 1373 (Art. II, § 8-17, of Ch. 8 of the Code of Ordinances of 1972). Subsequent amendments noted where applicable.]

It shall be unlawful for any person to abandon an underground service station tank or take a tank out of service for a period in excess of thirty (30) days or remove such tank from its existing location, unless the Chief of the Fire Department is first notified and the following safeguards undertaken:
A. 
Tanks temporarily out of service:
(1) 
The tank and lines shall be pumped dry.
(2) 
All lines, including the fill line, gauge hatch and pump section, shall be capped and secured against tampering.
(3) 
The vent line shall be opened.
B. 
Abandoning underground tanks in place:
(1) 
The tank and all connecting lines shall be pumped dry.
(2) 
The tank shall be flushed with water.
(3) 
All suction outlet, gauge and vent lines shall be disconnected.
(4) 
The tank and any remaining pipe stubs shall be filled with an inert solid material.
(5) 
All connecting lines below ground level shall be capped or plugged.
C. 
Removal of underground tanks:
(1) 
The tank and all connecting lines shall be pumped dry.
(2) 
The tank shall be flushed with water and rendered free from combustible gas.
(3) 
All suction, inlet, gauge and vent lines shall be disconnected.
(4) 
All inlets shall be capped or plugged.
(5) 
No tank may be junked unless it has been tested for explosive vapor and, if necessary, rendered gas-free. The walls of the tank shall be punctured to prevent its future use.
Any person who shall violate any provision of this chapter shall, upon conviction, be subject to a penalty as set forth in Chapter 1, General Provisions, Article III, General Penalty.
