Whenever it shall be made to appear to the Mayor and the police and the Sanitary Committee of the Borough of Catasauqua that unowned pigeons constitute a nuisance in and about the streets, parks or other public property within the Borough of Catasauqua, it shall be lawful for the Mayor and Police Department to provide for the destruction or killing of such unowned pigeons by any humane means.
Members of the Police Department or persons duly authorized by the Police Department may, upon request of the owners of private property, enter upon such property to eradicate unowned pigeons constituting a nuisance thereon in such manner as shall be directed by the Chief of Police of the Borough of Catasauqua, provided that such request be accompanied by a release of liability to the Borough of Catasauqua, its agents, servants and employees for injury to persons and damage to property which may occur in the eradication of unowned pigeons, in such form as may be required by the Police Department of the Borough of Catasauqua.
A. 
The Chief of Police and members of the Police Department of the Borough of Catasauqua are hereby authorized to use firearms and air rifles for the purpose of eradicating unowned pigeons under the authority of this article; and may authorize property owners and adult citizens of the Borough to use firearms and air rifles for that purpose in proper cases under the direct supervision of the Chief of Police or a member of the Police Department designated by the Chief of Police upon proof of financial responsibility in the form of a certificate of public liability and property damage insurance in such form and amount as shall be deemed necessary by said Chief of Police to indemnify the Borough of Catasauqua against loss or damage.
B. 
The shooting of firearms and air rifles within the geographical limits of the Borough of Catasauqua for the purpose and in the manner authorized by this article shall not constitute a violation of Ordinance 473, approved May 7, 1962, of the Borough of Catasauqua.[1]
