It shall be unlawful for the owner or occupant of any property in the Borough of Catasauqua to allow any water from the roof of any building owned or occupied by him to drain or run into any street or alley in the Borough except through a gutter or drain, not extending above the sidewalk, leading into such street or alley.

Any person or persons, firm or corporation, violating any of the provisions of this article shall, for each and every such violation, upon conviction thereof before the Mayor or any District Justice of the Borough, be sentenced to pay a fine of not more than $50 and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment in the County Jail for not more than 10 days. Provided: each week that any violation of this article shall continue, after the owner of any property shall have been notified thereof by the Borough, shall constitute a separate offense. Any person found guilty of violating an ordinance shall be assessed court costs and reasonable attorneys’ fees incurred by the Borough in the enforcement proceedings.
