As used in this article, the following terms shall have the meanings indicated:
OWNER
Any person owning or having a right of property to a dog, licensed or unlicensed, or any person having the control and custody of a dog, and the parents of any child under the age of 18 years who owns or has the control and custody of a dog, licensed or unlicensed.
It shall be unlawful for any owner of a dog, licensed or unlicensed, to cause or allow such dog to defecate upon any street, sidewalk, passageway, park, or any other public place where people congregate or walk, unless such owner shall immediately remove and dispose of in a sanitary manner all feces deposited by such dog.
It shall be unlawful for the owner of any dog, licensed or unlicensed, to cause or allow such dog to defecate upon any private property of another without the permission of the owner of said property.
At the trial of any charge of violating this article, if a dog has defecated upon public or private property as hereinbefore set forth, it shall be conclusively presumed that the owner of any such dog has caused or allowed the occurrence to have happened.
Any person violating any of the provisions of this article shall, upon conviction, pay a fine of not less than $10 nor more than $25 for each offense, to be collected as fines and penalties are now by law collectible.
