The following words and phrases, as used in
this article, shall have the meanings set forth in this section:
CENTRAL BUSINESS DISTRICT
The Central Business District is the area of the Borough
bounded by Wood Street, Liberty Street, Third Avenue and Ninth Avenue.
EXOTIC ANIMALS
Any mammal, bird, reptile or amphibian, other than a domestic
dog or cat.
NUISANCE
In addition to its common meaning, shall include but is not
limited to: defecation by animals on public property or on private
property without the consent of the property owner or other person
in charge of the property; accumulations of animal feces; threatening
or menacing behavior by animals, whether or not encouraged or abetted
by the owner or person having control, custody or supervision of the
animal.
SPECIAL EVENTS
Any event authorized by Clarion Borough Council, including
all public assemblies and processions, sidewalk sales, carnivals,
festivals, displays or sporting events.
No person shall walk, or otherwise have in his
custody, supervision or control, any animal upon any public property,
including streets, parking lots, sidewalks, roadways, tree lawns,
alleys or public parks or recreation areas, unless the person has
in his or her possession readily usable materials or implements sufficient
to immediately remove and lawfully dispose of any fecal matter that
may be deposited by the animal. Exception: This section shall not
apply to an animal while actually confined within a cage or vehicle.
No owner or person having any animal in his
custody, control or supervision shall possess, walk, display, exhibit
or expose, or permit or authorize to be possessed, walked, displayed,
exhibited or exposed, any animal upon public property, including parks,
recreation areas, alleys, sidewalks, highways, parking lots, streets
or tree lawns, at any special event held within the limits of Clarion
Borough, except where the specific animal has been approved as a participant
in that event. Exception: This section shall not apply to an animal
while securely and lawfully confined within a vehicle or trailer so
as to prevent escape or contact with other persons.
No owner or person having any exotic animal
in his or her custody, control, care or supervision shall possess,
walk, exhibit, display or expose, or permit or authorize to be possessed,
exhibited, displayed or exposed, any exotic animal upon public property,
parking lots, parks, sidewalks, streets, alleys or highways within
the Central Business District, except where such exotic animals have
been approved as a participant in a special event, and then only during
such periods of actual participation. All such exotic animals approved
for participation shall be securely and lawfully confined, restrained,
chained or caged so as to prevent escape or unwanted contact with
other persons.

Any person who violates any provision of this
article shall, upon conviction thereof in a summary proceeding before
a Magisterial District Judge having jurisdiction over such offense,
be sentenced to pay a fine of not less than $25 nor more than $600
together with costs and, in default of the payment of such fine and
costs, shall undergo imprisonment in the prison of Clarion County,
Pennsylvania, for a period not to exceed five days.
